Adulteration of the testing sample by addition of any substance to the testing sample that <br />is meant to mask orhide the presence of drugs or alcohol. <br />Failure to provide adequate testing sample for controlled substances testing without a <br />valid medical explanation after they have received notice of the requirement for testing in <br />accordance with the provisions of this part. <br />Failure to provide blood, urine, saliva, hair or breath for controlled substances or alcohol <br />testing without a valid medical explanation after they have received notice of the <br />requirement for blood or breath in accordance with the provisions of this part. <br />Engaging in conduct that clearly obstructs the testing process, and/or leaving the scene of an <br />on-the-job incident. <br />Substituting falsified (e.g., another individual's, synthetic, animal, etc.) urine, saliva, hair, <br />or blood in place of the person required to supply the sample. <br />Medication/Prescription Drugs/Physician's Care: <br />After submitting to a Fitness for Duty Test, an employee may voluntarily provide the Medical <br />Review Officer with documentation indicating that a positive result from the Fitness for Duty Test <br />could have been caused by ingesting medication or prescription drugs as directed by their <br />physician. If such evidence is presented to and accepted by the Medical Review Officer, a positive <br />test result will not result in termination unless intoxicant levels indicate dosages in an amount in <br />excess of that prescribed. Such information will be treated as strictly confidential. PCC does not <br />prohibit employees from using prescription or over-the-counter drugs when used as prescribed, <br />provided: <br />The prescription drugs are prescribed to the employee for medical reasons by a licensed <br />medical practitioner, with dosage and frequency of use prescribed on the label <br />documentation. <br />The employee's use of the prescription or over-the-counter drugs does not affect the <br />employee's job performance or conduct; threaten the safety, productivity, public image <br />or property of PCC or its employees; or result in criminal behavior. <br />No Employee is to perform any function or duty on behalf of PCC if the drugs being taken under <br />this provision adversely affect their ability to perform any such function or duty safely. <br />All employees must report, in writing, to Human Resources the use of prescribed or over-the- <br />counter medication that may affect their ability to work safely. Such information will be treated as <br />confidential and will be disseminated on a need -to -know basis only. PCC may restrict the <br />employee's work assignments while they continue to use such medication. Employees should <br />keep all medication in its original container which identifies the drug. <br />2. Disciplinary Rules <br />Penalties for Certain Violations Other Than a Non -Negative Fitness for Duty Test: <br />Possession, use, sale, transfer, manufacture, or distribution of a drug/alcohol while on <br />PCC Property or jobsites will result in disciplinary action up to and including termination <br />at PCC's sole discretion. <br />Criminal conviction based upon (a) sale, transfer, distribution, or possession with the intent <br />7 1 P a g e <br />
