structed by St. Joseph County from State Road 23 northerly to the <br />Calvert Street extension, approximately thirty -five hundred (3,500) <br />feet. The street, to be constructed in accord with detailed <br />specifications to be agreed to by the City of South Bend and St. <br />Joseph County, will be constructed so that a typical segment will be <br />forty (40) feet back -to -back of curb with integral concrete curbs and <br />ten (10) inch plain concrete pavement., The agreement will further <br />provide that St. Joseph County will acquire any needed right -of -way <br />for the construction and that the City of South Bend will provide for <br />needed storm sewers. Under the terms of the agreement, the City will <br />maintain the road for a period of four (4) years from the date of the <br />execution of the agreement. St. Joseph County will begin acquisition <br />procedures for the needed right -of -way for new Maple Road when the <br />City provides to St. Joseph County a written notice to proceed with <br />such acquisition. The City shall assure that the agreement is <br />executed by all necessary parties no later than October 9, 1981. The <br />agreement with St. Joseph County entitled, "Agreement Between the <br />City of South Bend, Indiana, and St. Joseph County, Indiana, for <br />Construction and Maintenance of Maple Road" shall be made a part of <br />this agreement and incorporated herein. <br />4. The City will apply for State funds for purposes of <br />relocating to the perimeter of the site the Indiana and Michigan <br />electric utility lines currently transversing the site. The Common <br />Council of the City shall pass a resolution on October 9, 1981 <br />authorizing the City to apply for State funds. Should State funds <br />not be made available to the City for this purpose or shall the State <br />make funds available to pay only a portion of the cost of relocation, <br />the City shall unconditionally pay all costs necessary to accomplish <br />the relocation. The City shall take action to assure that pre- <br />liminary engineering to accomplish such relocation shall commence <br />within thirty (30) days of execution of this agreement. The City <br />intends to accomplish this purpose through the enactment of an <br />ordinance under the provisions of I.C. 36- 7 -13 -3 creating a special <br />ME <br />
