315 REGULAR MEETING JULY 11, 1988 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, July 11, 1988, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Luecke, Soderberg, Puzzello, Slavinskas, Zakrzewski, Coleman, Duda and Voorde Absent: Council Member Niezgodski REPORT FROM THE SUB - COMMITTEE ON MINUTES To the Common Council of the City of South Bend: The sub- committee has inspected the minutes of the June 27 meeting of the Council and found them correct. Therefore, we recommend the same be approved. /s/ John Voorde /s/ Loretta Duda Council Member Coleman made a motion that the minutes of the June 27, meeting of the Council be accepted and placed on file, seconded by Council Member Puzzello. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole on July 11, at 7:06 p.m., with nine members present. Chairman Zakrzewski presiding. BILL NO. 15 -88 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 641 SANCOME AVENUE IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Puzzello made a motion to accept the substitute bill on file with the City Clerk, seconded by Council Member Voorde. The motion carried Council Member Slavinskas indicated the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorably. Kevin Joyce, Area Plan, gave the staff report, which was favorable to the rezoning. Richard Ludwick, Ludwick Printing, made the presentation for the bill. He indicated they were requesting this rezoning in order to build on to their present building. Council Member Voorde made a motion to recommend this bill to the Council favorably, as amended, seconded by Council Member Coleman. The motion carried. BILL NO. 31 -88 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 434 NORTH MICHIGAN IN THE CITY OF SOUTH BEND, INDIANA. This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Council Member Slavinskas indicated the Zoning and Vacation Committee had met on this bill and recommended it to the Council favorably. Kevin Joyce, Area Plan, gave the staff report which was favorable to the rezoning. Thomas Roemer, attorney, made the presentation for the bill. He indicated this area has changed over the years and is basically commercial. He indicated they were requesting the rezoning in order to establish this property was a boarding and lodging house. He indicated there was a need for this type of housing in the City. T. Brooks Brademas, 425 N. Michigan, indicated this was a classic example of spot zoning. He indicated this area has been changing into a commercial area and this type of establishment should not be in the area. Joseph Amaral, attorney, representing the owners of 436 N. Michigan, indicated this particular property has been as commercial for 18 years. He indicated this was definitely spot zoning. He indicated this is not the type of establishment City needs. He presented the Council with reports from Code Enforcement, as well as letters from surrounding commercial establishments against the zoning. He also presented pictures of the property. Council Member Puzzello made a motion to recommend this bill to the Council favorably, seconded by Council Member Voorde. The motion failed on a roll call vote of four ayes and four nays (Council Members Luecke, Soderberg, Slavinskas and Duda.) Council Member Slavinskas made a motion to recommend this bill to the Council unfavorably, seconded by Council Member Luecke. The roll call vote was five ayes and three nays, however, Council Member Voorde asked this his vote be changed to nay, making the motion fail on a vote of four ayes and four nays (Council Members Puzzello, Zakrzewski, Coleman and Voorde) Council Member Coleman indicated this bill should be continued and the Council should visit the property. Council Member Soderberg made a motion to continue this bill until the next meeting, seconded by Council Member Coleman. The motion passed on a roll call vote of seven ayes and one nay (Council Member Soderberg.) BILL NO. 38 -88 A BILL EXTENDING THE BOUNDARY OF THE TAX ABATEMENT IMPACT AREA WITHIN THE CITY OF SOUTH BEND.
