<br />REGULAR MEETING JULY 11, 1988
<br />Be it remembered that the Common Council of the City of South Bend met in the
<br />Council Chambers of the County -City Building on Monday, July 11, 1988, at 7:00 p.m.
<br />The meeting was called to order and the Pledge to the Flag was given.
<br />ROLL CALL Present: Council Members Luecke, Soderberg, Puzzello,
<br />Slavinskas, Zakrzewski, Coleman, Duda and
<br />Voorde
<br />Absent: Council Member Niezgodski
<br />REPORT FROM THE SUB - COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />The sub- committee has inspected the minutes of the June 27 meeting of the Council
<br />and found them correct.
<br />Therefore, we recommend the same be approved.

<br />Council Member Coleman made a motion that the minutes of the June 27, meeting of the
<br />Council be accepted and placed on file, seconded by Council Member Puzzello. The
<br />motion carried.
<br />COMMITTEE OF THE WHOLE
<br />Be it remembered that the Common Council of the City of South Bend met in the
<br />Committee of the Whole on July 11, at 7:06 p.m., with nine members present.
<br />Chairman Zakrzewski presiding.
<br />BILL NO. 15 -88 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 641
<br />SANCOME AVENUE IN THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Puzzello made a
<br />motion to accept the substitute bill on file with the City Clerk, seconded by
<br />Council Member Voorde. The motion carried Council Member Slavinskas indicated the
<br />Zoning and Vacation Committee had met on this bill and recommended it to the Council
<br />favorably. Kevin Joyce, Area Plan, gave the staff report, which was favorable to
<br />the rezoning. Richard Ludwick, Ludwick Printing, made the presentation for the
<br />bill. He indicated they were requesting this rezoning in order to build on to their
<br />present building. Council Member Voorde made a motion to recommend this bill to the
<br />Council favorably, as amended, seconded by Council Member Coleman. The motion
<br />carried.
<br />BILL NO. 31 -88
<br />A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 434
<br />NORTH MICHIGAN IN THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Slavinskas
<br />indicated the Zoning and Vacation Committee had met on this bill and recommended it
<br />to the Council favorably. Kevin Joyce, Area Plan, gave the staff report which was
<br />favorable to the rezoning. Thomas Roemer, attorney, made the presentation for the
<br />bill. He indicated this area has changed over the years and is basically
<br />commercial. He indicated they were requesting the rezoning in order to establish
<br />this property was a boarding and lodging house. He indicated there was a need for
<br />this type of housing in the City. T. Brooks Brademas, 425 N. Michigan, indicated
<br />this was a classic example of spot zoning. He indicated this area has been changing
<br />into a commercial area and this type of establishment should not be in the area.
<br />Joseph Amaral, attorney, representing the owners of 436 N. Michigan, indicated this
<br />particular property has been as commercial for 18 years. He indicated this was
<br />definitely spot zoning. He indicated this is not the type of establishment City
<br />needs. He presented the Council with reports from Code Enforcement, as well as
<br />letters from surrounding commercial establishments against the zoning. He also
<br />presented pictures of the property. Council Member Puzzello made a motion to
<br />recommend this bill to the Council favorably, seconded by Council Member Voorde.
<br />The motion failed on a roll call vote of four ayes and four nays (Council Members
<br />Luecke, Soderberg, Slavinskas and Duda.) Council Member Slavinskas made a motion to
<br />recommend this bill to the Council unfavorably, seconded by Council Member Luecke.
<br />The roll call vote was five ayes and three nays, however, Council Member Voorde
<br />asked this his vote be changed to nay, making the motion fail on a vote of four ayes
<br />and four nays (Council Members Puzzello, Zakrzewski, Coleman and Voorde) Council
<br />Member Coleman indicated this bill should be continued and the Council should visit
<br />the property. Council Member Soderberg made a motion to continue this bill until
<br />the next meeting, seconded by Council Member Coleman. The motion passed on a roll
<br />call vote of seven ayes and one nay (Council Member Soderberg.)
<br />BILL NO. 38 -88 A BILL EXTENDING THE BOUNDARY OF THE TAX ABATEMENT IMPACT AREA
<br />WITHIN THE CITY OF SOUTH BEND.
