The motion <br />ried. <br />ILL NO. 15 -88 <br />A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 641 <br />SANCOME AVENUE IN THE CITY OF SOUTH BEND, INDIANA. <br />it Member Luecke made a motion to continue public hearing on this bill until <br />11, seconded by Council Member Soderberg. The motion carried. <br />-88 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST <br />EAST /WEST ALLEY NORTH OF NORTHSIDE BLVD. RUNNING WEST FROM <br />OAKLAND ST., FOR A DISTANCE OF APPROXIMATELY 120 FEET TO THE <br />FIRST INTERSECTING NORTH /SOUTH ALLEY, ALL LOCATED IN OAKLAND PARK <br />ADDITION TO THE CITY OF SOUTH BEND. <br />s being the time heretofore set for public hearing on the above bill, proponents <br />opponents were given an opportunity to be heard. Council Member Slavinskas <br />icated the Zoning and Vacation Committee had met on this bill and recommended it <br />orably to the Council. John Mitchell, 1237 Oakland, made the presentation for <br />bill. He indicated they were requesting this vacation for public safety <br />poses. Council Member Voorde made a motion to recommend this bill to the Council <br />orably, seconded by Council Member Puzzello. The motion carried. <br />A BILL APPROPRIATING $53,000.00 RECEIVED FROM THE U.S. DEPARTMENT <br />OF HOUSING AND URBAN DEVELOPMENT, EMERGENCY SHELTER GRANT <br />PROGRAM. <br />it Member Luecke made a motion to continue public hearing on this bill until <br />25, seconded by Council Member Slavinskas. The motion carried. <br />-88 A BILL AMENDING THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, BY <br />THE INCLUSION OF NEW ARTICLE 1 OF CHAPTER 14 TO BE ENTITLED <br />ROLLER SKATES AND SKATEBOARDS. <br />his being the time heretofore set for public hearing on the above bill, proponents <br />aid opponents were given an opportunity to be heard. Council Member Soderberg <br />indicated the Public Safety Committee had met on this bill and recommended it to the <br />uncil favorably. Council Member Voorde made a motion to accept the substitute <br />11 on file with the City Clerk, seconded by Council Member Coleman. The motion <br />carried. Council attorney, Kathleen Cekanski- Farrand, indicated this bill should be <br />ended in Section 14.3 (a) last paragraph, after the word Code add ”, and on all <br />.sidewalks adjacent to nursing homes, hospitals, fire stations, schools, churches and <br />nagogues." Council Member Voorde made a motion to accept the amendment, seconded <br />Ir Council Member Slavinskas. The motion carried. Council Member Soderberg made <br />e presentation for the bill. He indicated this bill tries to effectively balance <br />e rights of individuals who wish to use skateboards and roller skates, as well as <br />tizens who wish to walk along public sidewalks. He indicated it prohibits the use <br />skateboards or roller skates on any City streets except when crossing at an <br />tersection, and at those times all safety regulations must be adhered to which <br />a ply to pedestrian and vehicular traffic; on any city sidewalk within the Central <br />B siness District, C -1, C -2,C,D and E districts; and requires all skateboards to <br />ide by all posted rules and regulations for any City owned facility where <br />ateboarding is permitted. Council Member Niezgodski made a motion to recommend <br />is bill to the Council favorably, as amended, seconded by Council Member <br />zzello. The motion carried. <br />38 -88 A BILL EXTENDING THE BOUNDARY OF THE TAX ABATEMENT IMPACT AREA <br />WITHIN THE CITY OF SOUTH BEND. <br />is being the time heretofore set for public hearing on the above bill, proponents <br />d opponents were given an opportunity to be heard. Council Member Luecke <br />indicated that the Human Resources Committee has met on this bill and recommended it <br />to the Council unfavorable. David Behr, a representative of the Holladay <br />Corporation, indicated they were developing the Memorial Skyway Plaza on the site t.ie former Travel Lodge. He indicated his was the most expensive project that has <br />been built in the downtown area. He indicated they were requesting this designation <br />4 order to qualify for a ten year abatement. After Council discussion regarding <br />e tending the downtown impact area, Council Member Coleman made a motion to continue <br />t�{�blic hearing on this bill until July 11, seconded by Council Member Voorde. The <br />[ ttion carried on a roll call vote of seven ayes and two nays (Council members <br />TIlecke and Puzzello.) <br />being no further business to come before the Committee of the Whole, Council <br />Coleman made a motion to rise and report to the Council, seconded by Council <br />Soderberg.
