am <br />BILL NO. 1 -88 <br />A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT <br />1305 S. MARIETTA IN THE CITY OF SOUTH BEND, INDIANA. <br />Kevin Joyce, Area Plan gave staff report. He indicated that the property in <br />question is being rezoned from "B" residential "A" Height & Area to "D" light <br />industrial "E" Height and Area usage. He indicated that the bill is being sent <br />with an unfavorable recommendation. Council Member Soderberg made the presentation <br />on the bill. He indicated that the petitioners. Mr. Willie Lee and Mr. Jeffie Lee, <br />are requesting the zone change to be able to park their truck on the adjacent lot. <br />Patricia De Clercq, Director, Department of Code Enforcement spoke opposed to the <br />bill. She indicated that the Department of Code Enforcement had held two hearings <br />on the property in question, in an unsuccessful effort to stop the petitioner from <br />storing metal and using the lot as a mini scrap yard. Council Member Niezgodski <br />made a motion to recommend this bill to the Council with an unfavorable <br />recommendation, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 8 -88 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING VARIOUS SECTIONS OF ARTICLE 5, CHAPTER 18 OF THE <br />MUNICIPAL CODE, COMMONLY REFERRED TO AS "PROCEDURES FOR VACATION <br />OF PUBLIC WAYS AND PUBLIC PLACES." <br />Council Member Luecke made a motion to continue public hearing on this bill until <br />March 28, seconded by Council Member Coleman. The motion carried. <br />BILL NO. 9 -88 A BILL APPROVING AN AMENDMENT TO THE INDUSTRIAL REVOLVING FUND <br />OF SOUTH BEND, INDIANA TRUST AGREEMENT. <br />Council Member Luecke made a motion to continue public hearing on this bill until <br />March 28, seconded by Council Member Niezgodski. The motion carried. <br />BILL NO. 13 -88 A BILL TRANSFERRING $373,814.00 AMONG VARIOUS ACCOUNTS WITHIN <br />THE DEPARTMENT OF ECONOMIC DEVELOPMENT. <br />BILL NO. 14 -88 A BILL TRANSFERRING $78,186.00 AMONG VARIOUS ACCOUNTS WITHIN THE <br />DEPARTMENT OF ECONOMIC DEVELOPMENT. <br />Council Member Puzzello made a motion to combine Bill Nos. 13 -88 and 14 -88 for <br />purposes of public hearing, seconded by Council Member Coleman. The motion <br />carried. Elizabeth Leonard, Economic Development Department, indicated that the <br />bills are needed to transfer monies that were left over from the 1987 budget. The <br />monies will be used for projects in the 1988 budget. Council Member Luecke, <br />Chairman of the Human Resources and Economic Development Committee stated that the <br />committee met March 14, 1988 at 5:00 p.m., and recommended that both bills go to <br />the Council with a favorable recommendation. Council Member Slavinskas made a <br />motion that Bill 13 -88 and 14 -88 go to the council favorable, seconded by Council <br />Member Coleman. <br />There being no further business to come before the Committee of the Whole, Council <br />Member Slavinskas made a motion to rise and report to the Council, seconded by <br />Council Member Coleman. Council Member Puzzello made a motion to pass the <br />bill, seconded by Council Member Coleman.
