am BILL NO. 1 -88 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1305 S. MARIETTA IN THE CITY OF SOUTH BEND, INDIANA. Kevin Joyce, Area Plan gave staff report. He indicated that the property in question is being rezoned from "B" residential "A" Height & Area to "D" light industrial "E" Height and Area usage. He indicated that the bill is being sent with an unfavorable recommendation. Council Member Soderberg made the presentation on the bill. He indicated that the petitioners. Mr. Willie Lee and Mr. Jeffie Lee, are requesting the zone change to be able to park their truck on the adjacent lot. Patricia De Clercq, Director, Department of Code Enforcement spoke opposed to the bill. She indicated that the Department of Code Enforcement had held two hearings on the property in question, in an unsuccessful effort to stop the petitioner from storing metal and using the lot as a mini scrap yard. Council Member Niezgodski made a motion to recommend this bill to the Council with an unfavorable recommendation, seconded by Council Member Coleman. The motion carried. BILL NO. 8 -88 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING VARIOUS SECTIONS OF ARTICLE 5, CHAPTER 18 OF THE MUNICIPAL CODE, COMMONLY REFERRED TO AS "PROCEDURES FOR VACATION OF PUBLIC WAYS AND PUBLIC PLACES." Council Member Luecke made a motion to continue public hearing on this bill until March 28, seconded by Council Member Coleman. The motion carried. BILL NO. 9 -88 A BILL APPROVING AN AMENDMENT TO THE INDUSTRIAL REVOLVING FUND OF SOUTH BEND, INDIANA TRUST AGREEMENT. Council Member Luecke made a motion to continue public hearing on this bill until March 28, seconded by Council Member Niezgodski. The motion carried. BILL NO. 13 -88 A BILL TRANSFERRING $373,814.00 AMONG VARIOUS ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. BILL NO. 14 -88 A BILL TRANSFERRING $78,186.00 AMONG VARIOUS ACCOUNTS WITHIN THE DEPARTMENT OF ECONOMIC DEVELOPMENT. Council Member Puzzello made a motion to combine Bill Nos. 13 -88 and 14 -88 for purposes of public hearing, seconded by Council Member Coleman. The motion carried. Elizabeth Leonard, Economic Development Department, indicated that the bills are needed to transfer monies that were left over from the 1987 budget. The monies will be used for projects in the 1988 budget. Council Member Luecke, Chairman of the Human Resources and Economic Development Committee stated that the committee met March 14, 1988 at 5:00 p.m., and recommended that both bills go to the Council with a favorable recommendation. Council Member Slavinskas made a motion that Bill 13 -88 and 14 -88 go to the council favorable, seconded by Council Member Coleman. There being no further business to come before the Committee of the Whole, Council Member Slavinskas made a motion to rise and report to the Council, seconded by Council Member Coleman. The motion carried. BILLS, SECOND READING ORDINANCE NO. 7853 -88 AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED DIRECTLY EAST AND NORTHEAST OF THE JAMISON INN IN THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Puzzello made a motion to pass the bill, seconded by Council Member Coleman. The bill passed by a roll call vote of nine ayes.
