REGULAR MEETING MARCH 11, 2025 47 ADOPTED at a meeting of the City of South Bend, Indiana, Board of Public Works held on March 11, 2025, at 1308 County-City Building, 227 West Jefferson Boulevard, South Bend, Indiana 46601. Miller ATTEST: s/ Theresa Heffner, Clerk ADOPT RESOLUTION NO. 11-2025 – A RESOLUTION OF THE CITY OF SOUTH BEND, INDIANA BOARD OF PUBLIC WORKS APPROVING THE TRANSFER OF CITY PROPERTY AT 123 W. COLFAX AVE. FOR THE MAIN STREET HOUSING REQUEST FOR PROPOSAL Upon a motion made by VP Molnar, seconded by Mr. Miller and carried by roll call, the following resolution was adopted by the Board of Public Works: RESOLUTION NO. 11-2025 A RESOLUTION OF THE CITY OF SOUTH BEND, ACTING THROUGH ITS BOARD OF PUBLIC WORKS APPROVING THE TRANSFER OF REAL PROPERTY TO THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the City of South Bend, acting through its Board of Public Works (the “City”) is the owner of certain property identified herein; and WHEREAS, pursuant to I.C. 36-1-11-8, the City, may transfer or exchange property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the South Bend Redevelopment Commission (the “Commission”), the governing body of the South Bend, Indiana, Department of Redevelopment (the “Department”) exists and operates under the provisions of I.C. 36-7-14, as amended from time to time (the “Act”) and is a body corporate and politic; and WHEREAS, the City desires to the transfer to the Commission certain real property as set forth in Exhibit “A” attached (collectively referred to as the “Property”); and WHEREAS, the Commission desires to accept the transfer of the Property from the City for purposes of redevelopment and will execute a mirroring resolution documenting such desire and; WHEREAS, the Commission is expected to adopt a corresponding resolution consistent with I.C. 36-1-11-8. NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND BOARD OF WORKS AS FOLLOWS: 1. The transfer of the following described real property situated in St. Joseph County, Indiana: See Exhibit “A” by the City to the Commission, without consideration, shall be, and hereby is, approved and authorized.
