124 <br />REGULAR MEETING JULY 27, 1987 <br />South 1/2 Lot #9 Samuel Martin's Addition <br />be designated as an Economic Revitalization Area under the provisions of Indiana <br />Code 6 -1.1- 12.1 -1, et seq.; and <br />WHEREAS, the Redevelopment Commission has concluded an investigation and <br />prepared a report with information sufficient for the Common Council to determine <br />that the area qualifies as an Economic Revitalization Area under Indiana Code <br />6 -1.1- 12.1 -1, et seq., and has further prepared maps and plats showing the <br />boundaries and such other information as required by law of the area in questions; <br />and <br />WHEREAS, the Human Resources and Economic Development Committee of the Common <br />Council has reviewed said report and recommended to the Common Council that the area <br />qualifies as an Economic Revitalization Area. <br />NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, <br />Indiana, as follows: <br />SECTION I. That the Common Council hereby accepts the report and recommendation <br />of the Human Resources and Economic Development Committee that the area herein <br />described be designated an Economic Revitalization Area and hereby adopts a <br />resolution designating this area as an Economic Revitalization Area for purposes of <br />real property tax abatement. <br />SECTION II. That this designation shall be limited to five (5) calendar years <br />from the date of the adoption of this resolution by the Common Council. <br />SECTION III. That the Common Council directs the City Clerk to cause notice of <br />the adoption of this resolution to be published, said publication providing notice <br />of the public hearing before the Common Council on said declaration. <br />SECTION IV. This resolution shall be in full force and effect from and after <br />its adoption by the Common Council and approval by the Mayor. <br />/S/ Joseph T. Serge <br />Member of the Common Council <br />A public hearing was held on the resolution at this time. Council Member Voorde <br />made a motion to amend this resolution in Section 2, delete five insert two, add a <br />new Section 4 to read: The abatement deduction shall be for six years. This <br />determination is made under the authority of I.C. 6 -1.1- 12.1 -3. Current Section <br />Four would be Section Five., seconded by Council Member Taylor. The motion <br />carried. Richard Lutin, 111 E. Main, Niles, indicated he planned to renovate this <br />building and use it as a music store. He indicated one full -time employee, and two <br />part -time employees will be hired. Council Member Taylor made a motion to adopt <br />this resolution, seconded by Council Member Beck. The resolution was adopted by a <br />roll call vote of seven ayes and two nays (Council Members Barcome and Paszek.) <br />Council Member Taylor made a motion to combine public hearing on the next two <br />resolutions, seconded by Council Member Zakrzewski. The motion carried. <br />RESOLUTION NO. 1525 -87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY <br />KNOWN AS 701 SOUTH CHAPIN STREET AN ECONOMIC <br />REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX <br />ABATEMENT. <br />WHEREAS, a petition for real property tax abatement consideration has been filed <br />with the Common Council of the City of South Bend, requesting that the area commonly <br />known as 701 South Chapin Street, South Bend, Indiana, and which is more <br />particularly described follows: <br />Situate in St. Joseph County in the State of Indiana: <br />That part of Bank Out Lots No. Seventy -six (76), Seventy -seven (77) and <br />Seventy -eight (78) of the Out Lots of the Town, now City of South Bend platted <br />by the State Bank of Indiana, and a Bank Out Lots Ninety -one (91), Ninety -two <br />(92), Ninety -three (93), One Hundred Four (104), One Hundred Five (105) and One <br />Hundred Six (106) of the 2nd Plat of the Out Lots of the Town, now City of South <br />Bend, platted by the State Bank of Indiana, bounded by the following described <br />line: Beginning at a point on the East line of Arnold St. 669.54 feet North of <br />the South line of said Bank Out Lot Ninety -three (93); thence Northeasterly at <br />an angle to the right of 61045' a distance of 52.48 feet; thence at an angle <br />to the right of 20014' a distance of 43.28 feet; thence at an angle to the <br />right of 8020' a distance of 211.68 feet; thence at an angle to the right of <br />16027' for a distance of 91.39 feet; thence at an angle to the right of 005' <br />a distance of 50.0 feet; thence at an angle to the right of 007' a distance of <br />50.0 feet; thence at an angle to the left of 0051a distance of 50.0 feet; <br />thence at an angle to the right of 002' a distance of 50.0 feet; thence at an <br />angle to the left of 0012' a distance of 50.0 feet; thence at an angle to the <br />right of 0017' a distance of 50.0 feet; thence at an angle to the right of <br />
