Sanitary Sewer and Water Easement, including a 20' wd. Ingress & <br />Egress Easement adjacent to Lots # 9 and 11 and the 10' wd. Utility Easement <br />located along the North right-of-way, South right-of-way and West right--of--way <br />of vorder_ Court, Right-of-ways are adjacent to Lots #5, 6, 7, 8, 9 and 11 of <br />"B.W. Business Park Major Subdivision" recorded as Doc. #0111166 in the records <br />of the St. Joseph County, Indiana Recorder's office: <br />Dear Ms. Jacobs; <br />Please accept this letter as our firm's written request on behalf of <br />our client, Tech Data, to have the Board of Public Works approve the release of <br />any easement rights your Board may have jurisdiction over in the proposed <br />Vacated Vorden Court, the 30' wd. Sanitary Sewer and Water Easement, including a <br />20' wd. Ingress & Egress Easement adjacent to Lots #9 and 11 to the North line <br />of Lot #10 and the 10' wd. Utility Easement that runs along proposed Vacated <br />Vorden Court flight -of -way as described above. For your convenience, we have <br />attached a copy of the proposed development plan for the property and have <br />highlighted the location of the proposed Vacated Vorden Court and said Utility <br />Easements. Our clients, Tech Data would like to build a new building on Lots <br />#5, 6, 7, 8 9, 11 and that part of proposed Vacated Vorden Court. Prior to Tech <br />Data being allowed to build over said lots and street right-of-way, they are <br />required to Replat the existing lots and vacated Vorden Court into one legal lot <br />of record. <br />The Replat procedure requires that any right-of-ways and or easements be <br />cleared of any potential easement rights. This process requires that we receive <br />a written verification from each Utility Company or Board, confirming that there <br />are no existing utility lines in the vacated street right-of-way and Utility <br />Easement and that the Utility Company or Board releases any easements rights in <br />said vacated Right-of-way and Easements including the ingress & egress easement. <br />We would appreciate that once the Board has approved the release of <br />easement rights, that we receive a letter affirming the action. We will record <br />the document with the St. Joseph County, Indiana Recorder's office and provided <br />a copy of said recorded document to your office for your records. <br />If you have any questions concerning this matter, please feel free to give me a <br />call at (574) 234-4003. <br />Michael J.
