REGULAR MEETING <br />JANUARY 28, 1991 <br />OF THE FIRST NORTH -SOUTH ALLEY WEST OF FELLOWS STREET, FOR A <br />DISTANCE OF APPROXIMATELY 132 FEET AND A WIDTH OF APPROXIMATELY <br />11 FEET. <br />Now is the time heretofore set for public hearing on this bill, proponents and <br />opponents were given an opportunity to be heard. Council Member Slavinskas <br />indicated the Zoning and Vacation Committee had met on this bill and recommended it <br />to the Council favorable. William Panzica, 422 E. Monroe, made the presentation for <br />the bill. He indicated they were requesting this vacation to allow cars to back out <br />into the alley way from paved parking stalls to be installed at 529 S. Fellows. He <br />indicated they did not plan to close the alley from public access. Council Member <br />Coleman made a motion to recommend this bill to the Council favorable, seconded by <br />Council Member Niezgodski. The motion carried. <br />BILL NO. 99 -90 <br />A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT <br />18106 IRELAND ROAD IN THE CITY OF SOUTH BEND, INDIANA FOR NORMAN <br />MELICR OF 18106 IRELAND ROAD, SOUTH BEND, INDIANA 46614. <br />Now is the time heretofore set for public hearing on this bill, proponents and <br />opponents were given an opportunity to be heard. Council Member Slavinskas <br />indicated the Zoning and Vacation Committee had met on this bill and recommended it <br />to the Council favorable. John Byorni, Area Plan, gave the Area Plan report, which <br />was favorable. Mike Danch, Peirce & Associates, made the presentation for the <br />bill. He indicated they were requesting this change of zoning in order to build a <br />restaurant. Council Member Coleman made a motion to recommend this bill to the <br />Council favorable, seconded by Council Member Zakrzewski. The motion carried. <br />BILL NO. 100 -90 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3900 <br />LINCOLNWAY WEST IN THE CITY OF SOUTH BEND, INDIANA. <br />Now is the time heretofore set for public hearing on this bill, proponents and <br />opponents were given an opportunity to be heard. Council Member Slavinskas <br />indicated the Zoning and Vacation Committee had met on this bill and recommended it <br />to the Council favorable. John Byorni, Area Plan, gave the Area Plan report, which <br />was favorable. Mike Dobson, B &R Oil, made the presentation for the bill. He <br />indicated they were requesting this zoning in order to building a convenience store, <br />car wash with gas sales. He indicated they planned to have two driveways in order <br />to ease any traffic problems that might occur. Jim Cook, Real Estate Broker, spoke <br />in favor of this zoning. He indicated B &R Oil was a local company with several <br />successful locations in the City. Council Member Niezgodski made a motion to <br />recommend this bill to the Council unfavorable, seconded by Council member <br />Puzzello. The motion failed don a roll call vote of five nays and four ayes <br />(Council Member Puzzello, Zakrzewski, Ladewski and Niezgodski.) Council Member <br />Coleman made a motion to recommend this bill to the Council favorable, seconded by <br />Council Member Soderberg. The motion carried on a roll call vote of five ayes and <br />four nays (Council Members Puzzello, Zakrzewski, Ladewski and Niezgodski.) <br />BILL NO. 101 -90 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED ON THE <br />EAST SIDE OF PORTAGE ROAD 385 FEET NORTH OF THE MAPLE ROAD AND <br />PORTAGE ROAD INTERSECTION IN THE CITY OF SOUTH BEND, INDIANA. <br />Now is the time heretofore set for public hearing on this bill, proponents and <br />opponents were given an opportunity to be heard. Council Member Slavinskas <br />indicated the Zoning and Vacation Committee had met on this bill and recommended it <br />to the Council favorable. John Byorni, Area Plan, gave the Area Plan report, which <br />was favorable. Jim Cook, Real Estate Broker, made the presentation for the bill. <br />He indicted Edward Rose Properties, planned to build a multi - family apartment <br />development at this location. Jerry Speedy, Vice President of Edward Rose, spoke <br />regarding this development. Council Member Luecke made a motion to recommend this <br />bill to the Council favorable, seconded by Council Member Zakrzewski. The motion <br />carried. <br />BILL NO. 102 -90 <br />A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE <br />NORTH EAST CORNER OF LINDEN AVENUE AND CLEMENS STREET EXTENDING <br />NORTH ON CLEMENS 988.71 FEET AND EAST OF LINDEN 480 FEET, IN THE <br />CITY OF SOUTH BEND, INDIANA. <br />Council Member Slavinskas made a motion to continue public hearing and third reading <br />on this bill until February 11, seconded by Council member Coleman. The motion <br />carried. <br />BILL NO. 4 -91 <br />A BILL OF THE COMMON COUNCIL FOR THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 2, ARTICLE 19, SECTION 2 -213 OF THE SOUTH BEND <br />MUNICIPAL CODE COMMONLY REFERRED TO AS "SCHEDULE OF ORDINANCE AND <br />CODE VIOLATIONS. <br />Now is the time heretofore set for public hearing on this bill, proponents and <br />opponents were given an opportunity to be heard. Council Member Duda indicated the <br />Committee of the Whole had met on this bill and recommended it to the Council <br />favorable. Council Member Niezgodski made the presentation for the bill. He <br />indicted this bill would correct an residential parking violation fee. Council <br />Member Puzzello made a motion to recommend this bill to the Council favorable, <br />seconded by Council Member Coleman. The motion carried. <br />
