<br />BILL NO. 97 -89 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT
<br />2411 SOUTH MAIN STREET, IN THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Slavinskas
<br />made a motion to amend this bill, seconded by Council Member Voorde. The motion
<br />carried. Council Member Slavinskas stated tha the Zoning & Vacation Committee met
<br />on this bill and recommends it to the Council favorable, as amended. Kevin Joyce,
<br />Planner, Area Plan Commission gave the staff report. Donald L. Ross, Vice
<br />President Real Estate Development, Cressy & Everett Commercial Company, 3930 Edison
<br />Lakes Parkway, Suite 200, Mishawaka, IN made the presentation on the bill. He
<br />indicated that the petitioner is requesting a zone change from "C" Commercial, "D"
<br />Height & Area to "D" Light Industrial "D" Height & Area to allow for a commercial
<br />and industrial mechanical contractor. Council Member Niezgodski made a motion to
<br />recommend this bill favorable, as amended to the Council, seconded by Council
<br />Member Zakrzewski. The motion carried.
<br />BILL NO. 116 -89 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: A PORTION OF
<br />WEST WAYNE RIGHT -OF -WAY FROM LOT *288 OF THE ORIGINAL PLAT OF
<br />SOUTH BEND.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Donald L. Ross, Vice
<br />President Real Estate Development, Cressy & Everett Commercial Company, 3930 Edison
<br />Lakes Parkway, Suite 200, Mishawaka, IN made the presentation on the bill. He
<br />indicated that the proposed bill would allow for the vacation of a portion of the
<br />sidewalk in the public right -of -way adjacent to 111 W. Wayne St. He stated that
<br />the petitioner proposes to construct a 14' x 4' greenhouse on the vacation
<br />right -of -way property. Council Member Zakrzewski made a motion to recommend this
<br />bill to the Council favorable, seconded by Council Member Niezgodski. The motion
<br />carried.
<br />BILL NO. 118 -89 A BILL APPROPRIATING $5,546.00 RECEIVED FROM THE STATE OF
<br />INDIANA DEPARTMENT OF HUMAN SERVICES, EMERGENCY SHELTER GRANT
<br />PROGRAM.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Voorde made a
<br />motion to amend this bill, seconded by Council Member Zakrzewski. The motion
<br />carried. Council Member Luecke stated that the Human Resources and Economic
<br />Development Committee met on this bill and recommends it to the Council favorable.
<br />Kathryn Baumgartner, Director, Bureau of Housing, made the presentation on the
<br />bill. She indicated that the City of South Bend has received funds through the
<br />Emergency Shelter Grants Program which is administered by the State of Indiana
<br />Department of Human Services, for the delivery of such services through the Council
<br />of Providers of Services to the Homeless (COPOSH) and the Youth Services Bureau of
<br />St. Joseph County. She stated that the funds will be used to defray part of the
<br />cost of providing meals at the Center for the Homeless and the Youth Services
<br />Bureau's Safe Station. She stated that she is a member of COPASH. Council Member
<br />Voorde made a motion to recommend this bill to Council favorable, seconded by
<br />Council Member Duda. The motion carried.
<br />BILL NO. 119 -89 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA
<br />AMENDING CHAPTER 2, ARTICLE 6, COMMONLY REFERRED TO A TAX
<br />ABATEMENT PROCEDURES.
<br />Council Member Luecke made a motion to continue this bill to the February 12, 1990,
<br />meeting of the South Bend Common Council, seconded by Council Member Voorde. The
<br />motion carried.

<br />ORDINANCE NO. 8059 -90 AN ORDINANCE AMENDING ARTICLES 1, 2, 3, 4, 5, AND 6
<br />OF CHAPTER 21 OF THE MUNICIPAL CODE OF THE CITY OF
<br />SOUTH BEND, INDIANA.
<br />This bill had second reading. Council Member Slavinskas made a motion to amend
<br />this bill, as amended in the Committee of the Whole, seconded by Council Member
<br />Coleman. The motion carried. Council Member Slavinskas made a motion to pass this
<br />bill, seconded by Council Member Coleman. The bill passed by a roll call vote of
<br />nine ayes.

<br />This bill had second reading. Council Member Puzzello made a motion to amend this
<br />bill, as amended in the Committee of the Whole, seconded by Council Member Duda.
<br />The motion carried. Council Member Puzzello made a motion to pass this bill,
<br />seconded by Council Member Coleman. The bill passed by a roll call vote of nine
<br />ayes.
