REGULAR MEETING
<br />JANUARY 22. 1990
<br />Council Chambers of the County -City Building on Monday, January 22, 1990, at 7:00
<br />p.m. The meeting was called to order and the Pledge to the Flag was given.

<br />REPORT FROM THE SUB- COMMITTEE ON MINUTES
<br />To the Common Council of the City of South Bend:
<br />The sub - committee has inspected the minutes of the January 8, 1990 meeting of the
<br />Council and found them correct.
<br />Therefore, we recommend the same be approved.

<br />Council Member Coleman made a motion that the minutes of the January 8, 1990,
<br />meeting of the Council be accepted and placed on file, seconded by Council Member
<br />Puzzello. The motion carried.
<br />Council Member Coleman made a motion to reappoint Herb Herendeen to the Historic
<br />Preservation Commission, seconded by Council Member Voorde. The motion carried.
<br />Council Member Soderberg made a motion to reappoint Jane Ann Petrass to the
<br />Historic Preservation Commission, seconded by Council Member Slavinskas. The
<br />motion carried.
<br />Council President Zakrzewski stated that there will be an Executive Session of the
<br />Common Council Thursday, February 1, 1990 at 4:30 p.m. to discuss stratedy with
<br />regard to collective bargaining.
<br />COMMITTEE OF THE WHOLE
<br />Be it remembered that the Common Council of the City of South Bend met in the
<br />Committee of the Whole on January 22, 1990, at 7:00 p.m., with nine members
<br />present. Chairman Coleman presiding.
<br />BILL NO. 140 -87 A BILL AMENDING ARTICLES 1, 2, 3, 4, 5, AND 6 OF CHAPTER 21 OF"
<br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA.
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Voorde made a
<br />motion to amend this bill, seconded by Council Member Zakrzewski. The motion
<br />carried. Council Member Slavinskas stated that the Zoning & Vacation Committee met
<br />on this bill and recommends the bill favorable, as amended. Kevin Joyce, Planner,
<br />Area Plan Commission gave the staff report. David Chapleau, Deputy City Attorney
<br />made the presentation on the bill. He indicated that the proposed bill amends many
<br />articles in Chapter 21 of the South Bend Municipal Code, the Zoning Chapter of the
<br />Code. Patricia DeClercq, Director Department of Code Enforcement spoke in favor of
<br />the bill. She indicated that the process for amending Chapter 21 of the Municipal
<br />Code entitled Zoning was very long in coming. She commended everyone who was
<br />involved for a job well done. Council Member Voorde made a motion to recommend
<br />this bill favorable as amended, seconded by Council Member Slavinskas. The motion
<br />carried.
<br />BILL NO. 96 -89 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT THE
<br />SOUTH EAST CORNER OF IRELAND RD. & MIAMI HWY. IN THE CITY OF
<br />SOUTH BEND, INDIANA, FOR SCOTTSDALE MALL PARTNERS LIMITED
<br />COMFORT SOUTH BEND, LTD. PARTNERSHIP, GENERAL PARTNER 200
<br />MADISON AVENUE NEW YORK, NEW YORK 10016
<br />This being the time heretofore set for public hearing on the above bill, proponents
<br />and opponents were given an opportunity to be heard. Council Member Zakrzewski
<br />made a motion to amend this bill, seconded by Council Member Slavinskas. The
<br />motion carried. Council Member Slavinskas stated that the Zoning & Vacation
<br />Committee met on this bill and recommends it to the Council favorable, as amended.
<br />Kevin Joyce, Planner, Area Plan Commission gave the staff report. Mike Danch,
<br />Peirce & Associates, 52578 U.S. 33 North, South Bend, made the presentation on the
<br />bill. He stated that the petitioner is requesting a zone change to allow for the
<br />construction of a shopping center /theater complex. John Wojtan, 6216 Exeter Ct.,
<br />spoke regarding the traffic on Miami Rd. He questioned whether or not the City
<br />plans to widen Miami from Ireland Rd. to Kern Rd. He stated that Miami Rd. does
<br />not have adequate traffic lights to handle the additional traffic that would be
<br />created by this project. Council Member Zakrzewski made a motion to recommend this
<br />bill to the Council favorable, seconded by Council Member Slavinskas. The motion
<br />carried.
