REGULAR MEETING <br />Sidewalk & Curb $18 /Lineal Foot <br />APRIL 23, 2013 128 <br />Section 2. The Board recognizes that there are significant benefits to having multiple <br />adjacent properties agreeing to replace their sidewalk and /or curbs at the same time. As such, the <br />Board hereby determines that in situations where two or more adjacent homeowners sign up for <br />the program at the same time they will receive the following discounts from the rates established <br />in Section l: <br />2 Adjacent Homeowners <br />10% Discount <br />3 Adjacent Homeowners <br />15% Discount <br />4 or More Adjacent Homeowners <br />20% Discount <br />Section 3. To encourage the redevelopment and rehabilitation of vacant and <br />abandoned homes, the Board hereby establishes a 50% discount to the rates established in <br />Section 1 for construction of sidewalk and /or curb for any property that is on the most recent <br />Vacant and Abandoned Homes List as determined by the Department of Code Enforcement. <br />Section 4. Costs incurred for the necessary construction of accessible sidewalk ramps <br />in compliance with the Americans with Disabilities Act will be considered incidental and paid <br />for by the City. Also, necessary reconstruction costs incurred for existing drive approaches in <br />the public right -of -way and tree removal and replacement in the public right -of -way will be <br />considered incidental and paid for by the City. <br />Section 5. NO. 24 -2013 — A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS OF THE CITY OF SOUTH BEND, INDIANA AUTHORIZING TRANSFER OF <br />PROPERTIES TO NON- PROFIT CORPORATION <br />Upon a motion made by Mr. Inks, seconded by Ms. Roos and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO. 24-2013 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORDS <br />OF THE CITY OF SOUTH BEND, INDIANA <br />AUTHORIZING TRANSFER OF PROPERTIES <br />TO NON - PROFIT CORPORATION <br />WHEREAS, the City of South Bend, Indiana, Board of Public Works (the "Board ") has <br />custody of and may maintain and dispose of all real property owned by the City of South Bend, <br />Indiana (the "City ") pursuant to I.C. 36 -9 -6 -3 and I.C. 36- 1 -11 -1; and <br />WHEREAS, the City is the owner of the real property identified in Exhibit "A" attached <br />hereto (the "City Parcels "); and <br />WHEREAS, the Northern Indiana Historical Society, Inc., is an Indiana non -profit <br />domestic corporation ( "NIHS ") which owns property adjoining or across the street from the City <br />Parcels; and <br />
