All rights reserved. <br />This is EXHIBIT K, consisting of 15 pages, referred to in <br />and part of the Agreement between Owner and Engineer <br />for Professional Services dated January 28, 2025. <br />AMENDMENT TO OWNER-ENGINEER AGREEMENT <br />Amendment No. 1 <br />1.Background Data: <br />a.Effective Date of Owner-Engineer Agreement: January 28, 2025 <br />b.Owner:Board of Public Works, City of South Bend <br />c.Engineer: Lochmueller Group, Inc. <br />d.Project:Riverfront West Urban Neighborhood Development <br />2.Description of Modifications: <br />a.Engineer shall perform or furnish the following Additional Services: <br />Project Description <br />The CONSULTANT shall study an approximately 17.0-acre area bounded by E. Wayne Street to the <br />north, MLK Jr. Blvd. to the west, East Monroe Street to the south and the St. Joseph River to the east to <br />develop a preliminary interior public street lay-out and water, sanitary sewer, and stormwater master plan <br />and provide design, plans, and contract documents for the northernmost section of street from Jefferson <br />Blvd. to approximately 640 feet south. A preliminary sketch of the potential development was provided <br />by Torti Gallas + Partners and “Concept Study 1” will be used as the basis to commence work on this <br />project. <br />Scope of Services <br />The scope of services to be provided by the CONSULTANT include the following: <br />1.TOPOGRAPHIC DATA COLLECTION SURVEY (original agreement): <br />1.1. Conduct a topographic survey of approximately 17.0 acres in size as shown in Attachment <br />“1.0” Survey Limits, generally described as being bound on the north by E. Wayne Street, <br />on the west by Doctor MLK Jr. Blvd., on the south by Monroe St. and on the east by the <br />existing sidewalk along the St. Joseph River, not including the area of the existing Post <br />Office. LiDAR data collection will be utilized for the majority of the project area to <br />minimize parcel access, increase survey crew safety in roadways and to reduce overall <br />survey effort and turnaround time. <br />1.2. As a minimum, the topographic survey shall include the location and elevation of all visible <br />features, including but not limited to building corners, paved and gravel surfaces, guardrail,
