(c) A department head may establish, abolish, or consoli- <br />date offices, divisions and bureaus within his department to permit <br />the proper and efficient operation of that department, subject to <br />availability of appropriated funds within the department and the <br />approval by the Mayor. <br />(d) A department head may supervise and coordinate the <br />boards, commissions, authorities, departments, offices, divisions and <br />bureaus within his department except where prohibited by state law. <br />(e) No department head may delegate his duty to administer <br />and supervise his department, to issue rules or regulations as <br />prescribed by law, or to have the ultimate responsibility for the <br />proper performance of the duties and functions vested in his <br />department. <br />(f) Each department shall exercise such powers and perform <br />such duties and functions as are prescribed by law and as are <br />directed by the Mayor. <br />Section 2 -21. Rules and Regulations <br />(a) "Rule" shall refer to the management of the internal <br />administration of an executive department or agency, and <br />"regulation" shall refer to imposition of a department or agency's <br />power on the public. <br />(b) In concert with the Law Department, each department head <br />may prescribe and promulgate such rules as are necessary to the <br />proper administration of the department, the conduct of its officers <br />and employees, the distribution and performance of its duties and <br />functions, and the custody, use, and preservation of its records, <br />papers, and property. In addition, in concert with the Law <br />Department and subject to approval of the Mayor, each department <br />head may promulgate such regulations as are authorized by law. <br />(c) A department head may amend, revise or repeal any rule <br />or regulation, subject to approval by the Mayor. <br />(d) All regulations and any amendment, revision or repeal <br />thereof shall be in writing and filed with the City Clerk. <br />Section 2 -22. Annual Reports <br />The director of each department and the presiding officer of <br />each executive board, commission and authority shall prepare and <br />submit to the Mayor and the Council by May 1st of each year, a report <br />of the functions, projects and activities of each department, board, <br />commission or authority for the preceding fiscal year. <br />Section 2 -23. Funding from Other Sources <br />(a) The City, through its departments, agencies, boards, <br />and commissions, is encouraged to secure funding from State, Federal <br />and private sources to further the effective and efficient operation <br />of its functions. <br />(b) Prior approval of the Mayor is required for participa- <br />tion in or contracting for participation in programs funded by <br />private, state or federal funds. <br />(c) When Common Council approval is not required for <br />application to private, state or federally funded programs, a summary <br />for any application made shall be submitted to the Council by the <br />applicant. <br />(d) All departments, agencies, boards, and commissions of <br />the City receiving funds pursuant to this section shall file with the <br />Council during the funding period annual reports detailing how the <br />moneys have been spent and obligated. <br />(e) Nothing in this section shall be construed to apply to <br />the submittal of forms required in connection with receiving motor <br />vehicle highway excise tax funds, cigarette excise tax funds, <br />3 <br />
