(c) The Board shall not assume liability for the maintenance <br />of the whole or any part of the principal of the amount received as <br />perpetual care funds. <br />(d) Funds received for the perpetual care fund of any lot <br />shall be kept separately and not commingled with any other funds. <br />(e) The Board shall not accept less than two dollars ($2.00) <br />per square foot as funds for the perpetual care of any lot in a City <br />cemetery. <br />Section 2 -140. Extension of cemetery ground. <br />(a) No person shall enlarge or extend any burial ground in <br />a City cemetery except in compliance with this section. <br />(b) Any person wishing to enlarge or extend any burial <br />ground in a City cemetery shall file with the Board of Public Works <br />a petition setting forth his request and including an accurate <br />description of the land constituting such enlargement or extension. <br />(c) The Board shall indicate its approval of such a <br />petition by written resolution embodying the specific description of <br />ground to be enlarged or extended. <br />(d) No body may be buried in any extension or enlargement of <br />burial ground in a City cemetery prior to the approval by the Board of <br />Public Works. <br />Section 2 -141. Rules of conduct for City cemeteries. <br />(a) The sexton may expel from the City cemetery anyone who <br />violates the rules of conduct under this section. Such expulsion <br />shall not preclude prosecution by the Law Department for ordinance <br />violation. <br />(b) The following conduct is prohibited in City cemeteries: <br />(1) Driving a vehicle faster than 15 miles per hour. <br />(2) Taking or removing any flower, tree or shrub. <br />(3) Defacing, disfiguring or injuring any monument, <br />fence, or other structure within the cemetery. <br />This sub - section shall not prevent the alteration <br />or removal of any structure or monument on a <br />private lot or grave by persons so authorized. <br />(4) Discharge of firearms, except at military fun- <br />erals and memorial celebrations. <br />(5) Sitting upon, walking or otherwise occupying <br />any private lot unless so authorized. <br />(6) Use of the city cemetery for any purpose other than <br />as a burying ground. <br />(7) Commiting any nuisance. <br />Sections 142 through 150. Reserved. <br />SECTION VIII. Chapter 2, Article 13 of the South Bend <br />Municipal o e is a eted in its entirety and reserved for future <br />use. <br />SECTION IX. Chapter 2, Article 14 of the South Bend <br />Municipal Code is deleted in its entirety, and a new Article 14 is <br />enacted as follows: <br />Article 14. Special Funds. <br />Section 2 -154. Bond sinking fund created. <br />A bond sinking fund is created for the gradual extinguishment <br />of the bonded indebtedness of the City. <br />11 <br />
