(1) Number and type of licenses issued. <br />(2) Revenue obtained from licenses issued by <br />license category. <br />Sec. 4 -15 Warning Notice and Citations <br />(a) Upon learning that a business requiring a license <br />under this chapter is doing business without a license, the <br />Controller may: <br />(1) Issue a warning notice to the violator stating <br />that he is in violation, that he has seven (7) days <br />in which to apply for a license and that failure to <br />do so may result in a Citation being issued for the <br />violation, or <br />(2) Request that a Citation be issued to the violator <br />imposing a twenty -five dollars ($25.00) fine. Each <br />subsequent day of violation shall be considered a <br />separate offense for which a Citation may be issued. <br />(b) The Warning Notice issued under this chapter shall <br />contain the date, time, name and address of the violator, the Code <br />s -ction violated, nature of the violation, location of the violation, <br />the name of the officer issuing the warning notice and the telephone <br />number of the office to contact for information. <br />(c) The Citation issued under this chapter shall contain <br />the date, time, name and address of the violator, the code section <br />violated, the nature of the violation, location of the violation, <br />the name of the officer issuing the Citation and instructions as to <br />disposition of the Citations. <br />Sec. 4 -16 Refusal to Issue, Suspension or Revocation of <br />Licenses <br />(a) The City Controller may refuse to issue a license and any <br />license issued pursuant to this Code may be suspended or revoked <br />by the City Controller after reasonable notice and hearing for any of <br />the following causes: <br />(1) any fraud, misrepresentation or false statement <br />contained in application for license; <br />(2) any fraud, misrepresentation or false statement <br />made in connection with the selling of goods, wares, <br />merchandise and services; <br />(3) any wilful violation of a term or condition of a <br />license; <br />(4) any wilful activity in violation of a statute or <br />provision of this Code related to the licensed business; <br />(5) conducting the activity in such a manner as to <br />constitute a breach of the peace or to constitute a menace <br />to the health, safety, welfare of the public. <br />(b) Unless provision is made under this Code for review before <br />a specified body or board, an applicant for or holder of any license <br />who has been aggrieved as a result of the refusal to issue a license <br />or the suspension or revocation of any license issued pursuant to <br />this Code, shall have the right to a hearing to review such refusal <br />to issue, supsension or revocation before the Mayor or his designee . <br />-5- <br />
