Sec. 21-198 Enforcement <br />The provisions of this Section shall be enforceable under the provisions of Section <br />21-166 of this Ordinance. The following additional enforcement provisions shall apply <br />to Signs (Sec. 21-195 (1) (G) or Lights (Sec. 21-195 (1) (I)) located on a Wireless <br />Telecommunications Facility. <br />(1) The citation for zoning violation maybe served by: personal service; certified <br />mail, return receipt requested; registered mail; or, by posting such notice in a <br />conspicuous place on the property where the violation occurs, and shall serve as <br />notice that a zoning violation has been committed. <br />(2) Each day a zoning violation remains uncorrected is a distinct and separate zoning <br />violation subject to an additional citation and fine in the amount prescribed below. <br />(3) Upon receipt of a citation for zoning violation pursuant to this Sec. 21-198 by the <br />person who commits such zoning violation or allows such zoning violation to be <br />committed on real estate in which the person has a possessory interest, said person <br />shall have a period often (10) days from the service of the citation for zoning <br />violation to take one of the following actions: <br />(A) Such person may elect to file a petition for variance to correct such <br />violation, in which case the person must indicate the intent to file such a <br />petition on the citation and return a copy to the Zoning Administrator or <br />appropriate enforcement official. During the pendency of said petition the <br />issuance of additional citations and additional monetary fines as <br />prescribed below shall be stayed. A person who files the petition within <br />said time period shall pursue the petition in an expeditious and diligent <br />manner. If the petition is denied, withdrawn or dismissed and the zoning <br />violation continues, then a lawsuit maybe commenced by the South Bend <br />City Attorney, Zoning Administrator or appropriate enforcement official <br />as provided by applicable laws. <br />(B) Such person may elect to appeal the decision of the enforcement official as <br />to the existence of a zoning violation as an Administrative Appeal before <br />the Board of Zoning Appeals. <br />(C) Such person may elect to stand trial for the violation by indicating on the <br />citation his intent to stand trial and returning a copy of the citation to the <br />Zoning Administrator or appropriate enforcement official. The returned <br />copy of the citation shall serve as notice of the person's intent to stand <br />trial. Upon receipt of the notice to stand trial, the issuance of additional <br />citations shall be stayed and additional monetary fines shall not be <br />assessed nor shall any monetary fines be collected which are not due for <br />more that five (5) days after the date of receipt of such notice of intention <br />to stand trial. After receipt of the notice of intention to stand trial, a <br />lawsuit may be commenced by the South Bend City Attorney, Zoning <br />i~ <br />
