REGULAR MEETING MAY 22, 1995 <br />reported that the Zoning and Annexation Committee had met on this bill and <br />recommended it to the Council favorable. John Byorni, Area Plan, indicated the bill <br />was initiated by Area Plan, which would allow the Area Plan staff to approve final <br />site plans. He indicated the site plans could be processed more efficiently if the <br />staff had authority to approve them. He indicated that final site plan approval was <br />more or less cut and dried. David Weisman, attorney for the Area Plan Commission, <br />indicated that 990 of all of the site plan approvals are routine. Council Member <br />Coleman made a motion to recommend this bill to the Council favorable, seconded by <br />Council Member Slavinskas. The motion carried. <br />BILL NO. 20 -95 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST NORTH - <br />SOUTH ALLEY WEST OF SOUTH FRANKLIN STREET ON WEST INDIANA, AND A <br />PORTION OF THE EAST -WEST ALLEY PARALLEL TO WEST INDIANA AVENUE <br />CONTINUING WEST THEREFROM <br />Council Member Luecke made a motion to continue this bill until June 12, at the <br />request of the petitioner, seconded by Council Member Washington. The motion <br />carried. <br />BILL NO. 24 -95 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />VACATING THE FIRST EAST -WEST ALLEY NORTH OF E. OHIO STREET FROM THE <br />EAST RIGHT -OF -WAY LINE OF SOUTH CARROLL STREET TO THE WEST RIGHT -OF- <br />WAY LINE OF SOUTH COLUMBIA STREET FOR A WIDTH OF 14 FEET AND A LENGTH <br />OF APPROXIMATELY 198 FEET; AND FROM THE EAST RIGHT -OF -WAY LINE OF <br />SOUTH COLUMBIA STREET TO THE WEST RIGHT -OF -WAY LINE OF SOUTH FELLOWS <br />STREET FOR A WIDTH OF 14 FEET AND A LENGTH OF APPROXIMATELY 198 FEET; <br />ALSO, COLUMBIA STREET FROM THE NORTH RIGHT -OF -WAY LINE OF EAST OHIO <br />STREET TO THE SOUTH RIGHT -OF -WAY LINE OF EAST SAMPLE STREET FOR A <br />WIDTH OF APPROXIMATELY 20 FEET AND A LENGTH OF APPROXIMATELY 278 FEET. <br />PARTS SITUATED IN KIRBY'S ADDITION TO THE CITY OF SOUTH BEND, ST. <br />JOSEPH COUNTY, INDIANA <br />This being the time heretofore set for public hearing on the above bill proponents <br />and opponents were given an opportunity to be heard. Council Member Puzzello <br />reported that the Public Works and Property Vacation Committee had met on this bill <br />and recommended it to the Council favorable. Council Member Ann Kolata, <br />Redevelopment Director, made the presentation for the bill. She indicated they were <br />petitioning, along with New Hope Missionary Baptist Church, to vacate some alleys and <br />a portion of Columbia Street. She indicated this vacation was necessary to allow the <br />expansion of the Church within the block. Council Member Luecke made a motion to <br />recommend this bill to the Council favorable, seconded by Council Member Washington. <br />The motion carried. <br />BILL NO. 25 -95 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE FIRST EAST /WEST <br />ALLEY NORTH OF W. CALVERT ST. FROM THE EAST RIGHT -OF -WAY LINE OF S. <br />PHILLIPA ST. TO THE WEST RIGHT -OF -WAY LINE OF THE FIRST NORTH -SOUTH <br />ALLEY EAST OF S. PHILLIPA ST. FOR A DISTANCE OF APPROXIMATELY 120 FEET <br />AND A WIDTH OF APPROXIMATELY 12 FEET. PART SITUATED IN SOUTH BEND <br />INDUSTRIAL ADDITION IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, <br />INDIANA <br />This being the time heretofore set for public hearing on the above bill proponents <br />and opponents were given an opportunity to be heard. He indicated he was representing Habitat for <br />Humanity, and they were requesting this vacation in order to make two buildable lots <br />60 foot wide. He indicated they alley has never been used. June Wesell, 1718 S. <br />Phillipa, indicated they owned five lots adjacent to this property, and she asked for <br />a six foot strip of land on the north. Council Member Zakrzewski made a motion to <br />recommend this bill to the Council favorable, seconded by Council Member Coleman. <br />The motion carried. <br />BILL NO. 27 -95 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, <br />AMENDING CHAPTER 2, ARTICLE 6 OF THE SOUTH BEND MUNICIPAL CODE <br />ADDRESSING TAX ABATEMENT PROCEDURES <br />Council Member Coleman made a motion to continue this bill until June 12, at the <br />request of the petitioner, seconded by Council Member Washington. The motion <br />carried. <br />Council Member Luecke made a motion to rise and report to the Council, seconded by <br />Council Member Coleman.
