REGULAR MEETING <br />MAY 22, 1995 <br />Be it remembered that the Common Council of the City of South Bend met in the Council <br />Chambers of the County -City Building on Monday, May 22, 1995, at 7:00 p.m. The <br />meeting was called to order and the Pledge to the Flag was given. <br />ROLL CALL Present: Council Members Luecke, Washington, Kelly, <br />Puzzello, Slavinskas, Zakrzewski, Coleman, Duda, <br />and Ladewski <br />Absent: None <br />REPORT FROM THE SUB - COMMITTEE ON MINUTES <br />To the Common Council of the City of South Bend: <br />The sub - committee has inspected the minutes of the May 8, meeting of the Council and <br />found them correct. <br />Therefore, we recommend the same be approved. <br />Eugene vLnadkw <br />// Lee aski <br />Council Member Coleman made a motion that the minutes of the May 8, meeting be <br />accepted and placed on file, seconded by Council Member Duda. The motion carried. <br />SPECIAL BUSINESS <br />RESOLUTION NO. 2240 -95 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, COMMENDING THE BETHEL PILOTS FOR WINNING THE <br />NAIA DIVISION II, NATIONAL CHAMPIONSHIP FOR 1995 <br />Council Member Coleman made a motion to hear this resolution later in the meeting <br />when Coach Lightfoot arrives, seconded by Council Member Washington. The motion <br />carried. <br />REPORTS OF CITY OFFICES <br />Don Fozo, Superintendent of the Building Department, gave a report on their every day <br />operation. He indicated that including the County, their territory was 427 square <br />miles; they issued 12,900 permits. He indicated each new home will receive at least <br />eight inspections; they have 11 full time inspectors, who made 41,300 inspections in <br />1994. He indicated in 1994 they had 1,236 licensed contractors and 38 new applicants <br />have now been tested. He indicated they also handled the zoning for the City of <br />South Bend. <br />Council Member Luecke made a motion to resolve into the Committee of the Whole, <br />seconded by Council Member Coleman. The motion carried. <br />COMMITTEE OF THE WHOLE <br />Be it remembered that the Common Council of the City of South Bend met in the <br />Committee of the Whole at 7:13 p.m., with nine members present. Chairman Washington <br />presiding. <br />BILL NO. 6 -95 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT LOT 5, <br />JOHN CARROLL SECOND MINOR, MAYFLOWER ROAD IN THE CITY OF SOUTH BEND <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Slavinskas made <br />a motion to accept he substitute bill on file with the City Clerk, seconded by <br />Council Member Coleman. The motion carried. Council Member Slavinskas reported that <br />the Zoning and Annexation Committee had met on this bill and recommended it to the <br />Council favorable. John Byorni, Area Plan, indicated the petitioner was requesting a <br />zoning change from "C" commercial to "D" light industrial to allow the construction <br />of mini warehouses. He described the surround area. He reported that Area Plan had <br />no recommendation. Mitchell Heppenheimer, attorney, representing the land owner as <br />well as the petitioner, made the presentation for the bill. He indicated this <br />project calls for six units to be built in phases, two at a time; each unit will have <br />37 bays. He indicated they will operate between the hours of 6:30 a.m. and 5:30 <br />P.M., with no evening access; the entire area will be fenced; there will be no <br />Utilities to the bays the only lighting will be for security. He indicated they <br />believed that miniwarehouses was the best use for this property. Jean Turner, 179 <br />Summit read three statements from residents - Kathy Bujeker, Kevin Plonka, and Stan <br />Wisniewski - who are opposed to the zoning. She indicated she was the only one who <br />received notice from Area Plan. She said they tried to rezone this property back in <br />1978 to light industrial. She indicated she was against this zoning due to <br />devaluation of her residence. Joe Weissfuss, 5215 Hazelwood Ct., and Lula Hall; <br />spoke against this zoning. Council Member Zakrzewski made a motion to recommend this <br />bill to the Council unfavorable, seconded by Council Member Washington. The motion <br />carried. <br />BILL NO. 21 -95 A BILL AMENDING AND SUPPLEMENTING CHAPTER 21, ZONING, OF THE MUNICIPAL <br />CODE OF THE CITY OF SOUTH BEND, INDIANA, AS AMENDED, DELETING AND <br />REPLACING ARTICLE 7, REZONING PROCEDURES AND BY ADDING TO AND MAKING <br />CERTAIN OTHER REVISIONS TO THE ZONING ORDINANCE <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard.
