In <br />surveying various matters for the Town of Roseland, the Area Plan <br />Commission pointed out that the property had never been legally <br />annexed. <br />The property actually lies within the town limits or, according to its <br />counsel, adjacent thereto. It is merely an easement for I & M and <br />Conrail, according to Roseland's counsel. <br />In order to resolve the matter, Roseland wishes to follow formal <br />annexation procedures to clarify the town boundaries. <br />Pursuant to I.C. 36- 4 -3 -9, Roseland must have the consent of the City <br />of South Bend before annexing territory within three miles of South <br />Bend's city limits. <br />If you have any questions about this matter, please don't hesitate to <br />contact me. <br />Since ely, <br />Richard L.
