BILL NO. <br />ORDINANCE N0. 7 97-e5 <br />AN ORDINANCE CONSENTING TO THE ANNEXATION <br />BY THE INCORPORATED TOWN OF ROSELAND, INDIANA, <br />OF CERTAIN TERRITORY <br />STATEMENT OF PURPOSE AND INTENT: <br />I.C. 36 -4 -3 -9 requires that a <br />legislative body of a second class city <br />within three miles of the corporate bow <br />incorporated Town of Roseland, Indiana, <br />territory located within three miles of <br />City of South Bend. <br />town obtain the consent of the <br />before annexing territory <br />adaries of that city. The <br />wishes to annex certain <br />the corporate boundaries of the <br />NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, as follows: <br />SECTION I. The Common Council of the City of South Bend <br />gives its consent to the annexation by the incorporated Town of <br />Roseland, Indiana, of the following territory which is located within <br />three miles of the corporate boundaries of the City of South Bend: <br />A parcel of land located in the West 1/2 <br />of the Southwest Quarter of Section 25, <br />Township 38 North, Range 2 East being more <br />particularly described as: Beginning at the <br />Northwest corner of W. D. Guy's First Addition <br />to the Town of Roseland as shown in the St. <br />Joseph County Recorder's Office Book 11, <br />page 151; thence West 50' more or less to the <br />East right -of -way line of the Conrail Railroad; <br />thence South along said right -of -way line to <br />the South right -of -way line of Cripe Street; <br />thence West along said right -of -way line 62' <br />more or less to the West right -of -way line of <br />the Conrail Railroad; thence South along said <br />West right -of -way line to a point of inter- <br />section with the South right -of -way line of <br />Warren Street extended West; thence East along <br />said extended line 112' more or less to the <br />Southwest corner of Johnson's Addition to the <br />Town of Roseland as shown in the St. Joseph <br />County Recorder's Office Book 10, pages 158 <br />and 159; thence North to the point of beginning <br />containing approximately 3.99 acres. <br />SECTION II.
