ORDINANCE NO. 7167 -83 <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, AMENDING <br />CHAPTER 2, ARTICLE 17, SECTION 2 -205 OF <br />THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND, <br />INDIANA, COMMONLY REFERRED TO AS FEES <br />CHARGED FOR LEGAL ADVERTISEMENTS. <br />STATEMENT OF PURPOSE AND INTENT <br />In 1980, the Common Council passed Ordinance No. 6836 -80 <br />which authorized the City to collect fees from petitioners to <br />cover the costs of advertising tax abatements, voluntary annexations, <br />vacations of public ways, and rezonings. <br />The undue and excessive bookkeeping procedures resulting <br />from passage of that Ordinance has prompted the following amendments. <br />The Office of the City Clerk believes that the amendments would <br />streamline this procedure and would result in a more efficient <br />and workable operation. <br />NOW, THEREFORE, BE IT ORDAINED by the Common Council of the <br />City of South Bend, Indiana, as follows: <br />SECTION I. Chapter 2, Article 17, Section 2 -205 of the <br />Municipal Code of the City of South Bend, Indiana, is amended to <br />read as follows: <br />ARTICLE 17. CHARGES FOR DIRECT CITY EXPENDITURES <br />Sec. 2 -205. Fees Charged for Legal Advertisements. <br />All petitioners seeking tax abatements, voluntary annexa- <br />tions, vacation of public ways, or rezonings, except those <br />rezonings petitioned for by the Area Plan Commission or a <br />member of the Common Council, shall ire - charged -tire- exact -fee <br />aeeessari +y remit the sum of One Hundred Dollars ($100.00) <br />at the time of filing said Petition. Said sum is non - refundable <br />and shall be used to fulfill all legal advertisement requirements <br />of such proceedings incurred by the City. <br />SECTION II.
