REGULAR MEETING OCTOBER 22, 2024 221
when you have work that needs to be completed and nobody's quoting on it or bidding on it and
the the dollar amount is lower, they make that distinction between the quoting and bidding of being
able to go out to open market. The Board is in good standing to make those approvals on Tuesday.
PROJECT COMPLETION AFFIDAVITS
Attorney Schmidt addressed the MWBE goals for item 6. A.: LaSalle Avenue Streetscape, stating
that this item may get tabled on Tuesday because there is a gap in B2Gnow (a diversity
management and compliance software) on one (1) of the sub -contractors. We have every reason
to believe that the contractor's subcontractors have been paid appropriately, but we want to
confirm.
Attorney Schmidt addressed the MWBE goals for item 6.B.: Campeau Street Streetscape, stating
that the goals were met.
Attorney Schmidt addressed the MWBE goals for item 6. 2023 Traffic Calming Divisions 1-5,
stating that the goals were exceeded.
PRIVILEGE OF THE FLOOR
Board Member Gary Gilot noted an email from a homeowner, Mr. Shearer, about a utility pole
that belongs to AEP. He noted we have directed him to AEP a number of times, but he is asking
the city to do something at the next Board meeting.
Director of Public Works Horvath stated that he meant to forward the email to AEP, so they know
what is going on. Mr. Shearer wants a yes or a no, but there were a lot of questions in the email.
Ultimately it is an issue between him and AEP.
Attorney Schmidt stated that back in May we brought to the Board a quick claim deed for some
property associated with McCormick out by the airport and sort of a redevelopment deal from
many moons ago. Through reasons unknown, the Board properly took action to authorize the quick
claim deed and it was part of a resolution that sort of spoke to this. We have been unable to find
the original copy of the quick claim deed though we did scan the resolution and everything in.
Long story short, McCormick is unable to record the deed because it doesn't have an original copy
of the claim deed so we're going to sort of modify the resolution because the Board already took
action and had notarized the deed. For the resolution, if he gets it done in time, the Board is going
to have a second resolution, which is basically going to mirror the first resolution, but it is also
going to have a little section that explains that while the Board took action, this was never recorded,
so the Board is taking additional action to make sure that the deed gets recorded.
ADJOURNMENT
There being no further business to come before the Board, President Maradik adjourned the
meeting at 10:44 a.m.
CITY OF SOUTH BEND, INDIANA
BOARD OF PUBLIC WORKS
Elizabeth A.
