One (1) to Five (5) employees $10,000.00 <br />Six (6) to Ten (10) employees $20,000.00 <br />Eleven (11) or more employees $50,000.00 <br />The UNION may withdraw bargaining unit Employees from EMPLOYERS who fail to maintain <br />the bond required by this Article. <br />The EMPLOYER assigns all right, title and interest in the Surety Bond to the UNION and Fringe <br />Benefit Trust Funds, which shall have a priority interest to such Funds, and supersede the claims <br />of all EMPLOYER'S creditors. Those EMPLOYERS who have regularly employed bargaining <br />unit employees under this or a predecessor or successor contract during 24 consecutive months <br />and who have made all payments herein required in a timely manner during that period are <br />hereby exempt from furnishing a Surety Bond until such time as they become delinquent. <br />ARTICLE XVIII <br />Drug Testing Program <br />Zone I Only (A) Various Employer Associations and the UNION members are of Building and <br />Construction Resource Center, Inc. (hereinafter "BCRC"), a non-profit corporation that was <br />formed to provide services in the construction industry, including, but not limited to, education <br />and referral services concerning alcohol, drug, and other substance abuse, which purposes are <br />more fully defined in the Articles of Incorporation and By -Laws of said BCRC and Fund Trust <br />Agreement and Declaration of Trust. <br />(B) Each EMPLOYER under this Agreement shall pay to BCRC the amount specified in the <br />wage and fringe benefit section of the Agreement which is ($0.13) thirteen cents per each hour <br />worked by its employees covered by this Agreement beginning June 1, 2022 and ($0.15) fifteen <br />cents per hour beginning June 1, 2023. Each EMPLOYER is obligated to make such <br />contributions, regardless of whether or not such EMPLOYER is a member of BCRC. <br />(C) Payments required to be made to BCRC shall be deemed to be governed by the provisions of <br />this Agreement pertaining to the collection of the Health and Welfare and Pension payments <br />required to be made by the EMPLOYERS and thus, may be enforced in the same manner. <br />(D) The Board of Directors of BCRC will have full audit authority of the EMPLOYER'S books <br />and records as they pertain to this contribution. <br />(E) The Employees covered by this Agreement will abide by the provisions of the BCRC <br />substance abuse program when required by the Owner. <br />Substance Abuse Program Zone II &III Only. The UNION and the EMPLOYER, hereby <br />agree that the Drug and Alcohol Testing program ("Program") administered by the Indiana <br />Union Construction Industry Substance Abuse Trust is incorporated by reference herein and <br />(21) <br />
