REGULAR MEETING OCTOBER 27,1997 Be it remembered that the Common Council of the City of South Bend met in the Council Chambers of the County -City Building on Monday, October 27, 1997, at 7:00 p.m. The meeting was called to order and the Pledge to the Flag was given. ROLL CALL Present: Council Members Aranowski, Pfeifer, Kelly, Broden, Varner, Ujdak, Coleman, Hosinski and Sniadecki Absent: None Minute approval is under unfinished business. Council Member Coleman made a motion to resolve into the Committee of the Whole, seconded by Council Member Hosinski. The motion carried. COMMITTEE OF THE WHOLE Be it remembered that the Common Council of the City of South Bend met in the Committee of the Whole at 7:03 p.m. with nine members present. Chairman Coleman presiding. BILL NO. 96 -97 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE STREET TO BE VACATED IS TUTT STREET FROM THE WEST RIGHT -OF -WAY OF SOUTH MICHIGAN STREET TO THE EAST RIGHT -OF -WAY OF THE FIRST NORTH -SOUTH ALLEY WEST OF SOUTH MICHIGAN STREET FOR A DISTANCE OF APPROXIMATELY 103 FEET AND A WIDTH OF 50 FEET. PART LOCATED IN GARST'S 1ST ADDITION TO THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity to be heard. Richard Nussbaum, City Attorney, indicated this vacation would be for the Homeless Shelter, which is nationally recognized as a model center. He reported that this vacation would allow them to continue to fulfill their mission. Drew Buscareno, development director for the center, made the presentation for the bill. He indicated they were requesting the vacation of Tutt Street in order to enlarge the center so there are more facilities for families. He reported they will move their service facilities, which will give them an opportunity to meet the increased demand. Stanley Blenke, executive vice president of Schafer Gear, reported they have a fair amount of truck traffic and with the closing of that portion of Tutt they will have to go to South Street, and return on Main, and we will have to remove three parking spaces for the trucks to reach the docks. He asked that the Center consider the possibility of vacating the alley that runs past the DeCocker Building. Art Linen, 755 S. Michigan, spoke against this vacation. He reported that the Center is already using the parking places in front of his business, and the closing of Tutt will only add to the existing problem. He asked that this bill be continued for six months, so the parking situation can be addressed. Mr. Buscareno indicated the Center is going to create a parking lot on the south side of Sample next to the Victory Bar. After discussion, Mr. Buscareno requested that this bill be continued until the November 24 meeting of the Council. Council Member Kelly made a motion to continue the bill, seconded by Council Member Hosinski. The motion carried. BILL NO. 79 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1710 EDISON ROAD IN THE CITY OF SOUTH BEND, INDIANA This being the time heretofore set for public hearing on the above bill, proponents and opponents were given an opportunity
