REGULAR MEETING MAY 12. 1997 <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Varner reported that the Public Works <br />and Property Vacation Committee had met on this bill and <br />recommended it to the Council favorable. Ken Fedder, attorney <br />for the petitioner, made the presentation for the bill. He <br />indicated the petitioner, the abutting property owner, as well as <br />the remaining affected property owners have agreed this alley <br />should be closed. He reported that the alley in question has <br />been a route for people the neighbors do not want in their area, <br />and there has also been vandalism. Council Member Varner made a <br />motion to recommend this bill to the Council favorable, seconded <br />by Council Member Aranowski. The motion carried. <br />BILL NO. 12 -97 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY <br />LOCATED ON FELLOWS STREET AT THE INTERSECTION WITH <br />VACATED KEASEY STREET IN THE CITY OF SOUTH BEND, <br />INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Hosinski made a motion to accept the <br />substitute bill on file with the City Clerk, seconded by Council <br />Member Kelly. The motion carried. Council Member Hosinski <br />reported that the Zoning and Vacation Committee had met on this <br />bill and recommended it to the Council favorable. John Byorni, <br />Area Plan, reported that the petitioners were requesting this <br />change of zoning to "PHC" to allow for a medical clinic. He <br />indicated this property was vacant land totaling 2.8 acres, which <br />is directly south of the new Family and Children's Center. He <br />reported that the Area Plan Commission recommended this zoning to <br />the Council favorable. Michael Hardy, attorney, made the <br />presentation for the bill. He indicated this bill and site <br />development plan of Family & Children's Center Properties <br />Management and the South Bend Redevelopment Commission to zone <br />this property to "PHC", in order that Memorial Health Systems can <br />construct a clinic. He reported this zoning was compatible with <br />the other uses in the area. Council Member Kelly made a motion <br />to recommend this bill to the Council favorable, as amended, <br />seconded by Council Member Broden. The motion carried. <br />BILL NO. 17 -97 <br />A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY <br />LOCATED ON THE 1600 BLOCK OF N. MAPLEWOOD STREET, <br />800 FEET NORTH OF LINCOLN WAY AVENUE IN THE CITY <br />OF SOUTH BEND, INDIANA <br />This being the time heretofore set for public hearing on the <br />above bill, proponents and opponents were given an opportunity to <br />be heard. Council Member Hosinski reported that the Zoning and <br />Vacation Committee had met on this bill and recommended it to the <br />Council favorable. John Byorni, Area <br />Plan, reported that the petitioners were requesting this rezoning <br />in order to build a transmitter tower. He indicated that the <br />Area Plan Commission recommended this to the Council favorable, <br />however, this should not mean that industrial development is <br />appropriate in residentially zoned areas, however, this property <br />is located within the Airport 2010 project. Charles Hayes, the <br />petitioner, made the presentation for the bill. He advised his <br />company was in the process of constructing this type of a tower <br />and transmitters at specified locations in the area, which will <br />relay signals for telecommunications. Council Member Aranowski <br />made a motion to recommend this bill to the Council favorable, as <br />amended, seconded by Council Member Pfeifer.
