day and have the capability of storing thirty (30) or more vehicles. The storage yard <br />shall be located within five (5) miles of the City of South Bend. Inside storage shall <br />be available if required by the City or if required for the preservation and security of <br />the towed vehicle. <br />6) Communication. Tow Companies, during the term of this contract, shall maintain a <br />continuous means of communication between Tow Companies' dispatcher and each <br />of Tow Companies' vehicles. Tow Companies shall provide the City with a contact <br />phone number that will be staffed 24 hours a day, 365 days a year. The Towing <br />Companies shall at all times maintain communications with its office, the City's <br />Police Department, and all mobile units. If Towing Companies' telephone or radio is <br />not promptly answered, or if the line is busy when called by the City after three (3) <br />attempts, the City may elect to contact another tow company to service the call. <br />7) Hours. The Towing Companies shall maintain and post minimum business hours for <br />- the release of stored vehicles as follows: <br />a) Monday through Friday, from 9:00 AM to 5:00 PM; and <br />b) Saturdays, from 8:00 AM to 12:00 PM. <br />The Towing Companies shall also provide off -hour vehicle pickup but may charge <br />those wishing to use such service a reasonable fee for same. <br />8) Inspection. If the City desires to inspect any vehicle in possession of the Towing <br />Companies as a result of the Towing Service, the Towing Companies shall provide <br />the City immediate access to said vehicle. <br />9) Assignment. Towing Companies shall not assign their rights under this contract to <br />any other person or entity without the City's prior written consent. Any such <br />assignment without prior consent of the City shall be void and the attempted <br />assignment shall constitute a material breach of contract. <br />10) Records. For its own and private internal operational documentation and accounting <br />- purposes only, the Towing Companies shall at all times maintain separate and <br />adequate financial records necessary for its lawful business operations, kept in the <br />normal and ordinary course of business and in an easily retrievable manner, in <br />connection with the Towing Service provided to the City. Towing Companies know <br />and understand that if the City receives a complaint or information challenging the <br />Towing Companies' compliance with any of the terms of this agreement, then the <br />Towing Companies will, pursuant to request from the City, cooperate fully with the <br />City's investigation, including releasing to the City those records relevant to the <br />Towing Companies' compliance with their duties under the Towing Companies' <br />Agreement with the City. <br />Records to be maintained shall include the following: <br />a) Time, date, location of tow, and officer authorizing tow; <br />
