Every effort will be made to conduct any required reasonable <br />suspicion alcohol test within 2 hours of the reasonable suspicion <br />determination. <br />lf a reasonable suspicion alcohol test is not administered within 2 hours <br />following the reasonable suspicion determination, Visu-Sewer will document <br />the reasons why the test was not promptly administered, and continue its <br />effort to administer an alcohol test for up to 8 hours following the reasonable <br />suspicion determination. lf the test is not administered within 8 hours <br />following the reasonable suspicion determination, Visu-Sewer will no longer <br />attempt to administer an alcohol test and will document the reasons for its <br />inability to do so. <br />Notwithstanding the above testing requirements, a driver may not report for <br />duty or remain on duty requiring the performance of a safety-sensitive <br />function if that driver is under the influence of or impaired by alcohol, as <br />shown by the behavioral, speech and performance indicators of alcohol <br />misuse. Any such driver will not be allowed to perform or continue to perform <br />a safety-sensitive function until the driver undergoes an alcohol test yielding <br />an alcohol concentration level of less than 0.02; or twenty-four hours have <br />elapsed following the reasonable suspicion determination. <br />Visu-Sewer will not take any disciplinary action against a driver based solely <br />upon observations of the driver's behavior and appearance, with respect to <br />alcohol use, in the absence of an alcohol test, unless such conduct warrants <br />referral to a substance abuse professional for an assessment, if appropriate. <br />ln any reasonable suspicion testing circumstance, a Company representative <br />will transport the individual to an appropriate collection facility and await the <br />completion of the collection procedure. The Company representative will <br />then transport the individual back to Visu-Sewer's premises, where a spouse, <br />family member or other individual will be contacted to transport the individual <br />home. ln the event no such individual is available, Visu-Sewer will contact a <br />taxi to transport the driver home. lf the reasonable suspicion test result is <br />negative, Visu-Sewer will reimburse the employee for the cost of the taxi. lf <br />the employee refuses to comply with any of these procedures and attempts <br />to operate his/her own vehicle, Visu-Sewer will take appropriate efforts to <br />discourage him from doing so, up to and including contacting local law <br />enforcement officials. Any employee failing to cooperate with any of the <br />above procedures will be subject to discipline, up to and including discharge. <br />ln the event Visu-Sewer determines that a driver is in possession of alcohol in <br />violation of this Policy, Visu-Sewer will utilize the disciplinary policy outlined in <br />this Policy as a course of action. <br />Return-To-Duty <br />Before a driver who has engaged in any conduct prohibited by this Policy will <br />be allowed to return to duty to perform a safety-sensitive function, he/she will <br />be required to undergo return-to-duty alcohol and/or controlled substance <br />tests, with results indicating an alcohol concentration of less than 0.02 and a <br />verified negative for controlled substances use, respectively. <br />aa <br />a
