a <br />pools for each agency; or establishing one random testing pool with selection <br />to occur at the highest minimum rate established by any agency to which <br />Visu-Sewer is subject. <br />The random selection process will be completely objective and anonymous <br />and will utilize a scientifically valid method such as a random number table or <br />a computer-based random number generator matched with drivers' Social <br />Security numbers, payroll identification numbers, or other comparable <br />identifying numbers. The tests will be unannounced and the dates for testing <br />will be reasonably spread throughout the course of the year. All drivers will <br />have an equal chance of being tested at any time, regardless of the number <br />of his/her previous selections. <br />When Visu-Sewer requires non-DOT employees to submit to random drug <br />and/or alcohol testing, those employees will be selected for testing from a <br />random testing pool separate and distinct from any pool containing drivers <br />subject to FHWA-mandated random testing. <br />Any driver notified of his/her selection for random alcohol andior controlled <br />substances testing will be expected to proceed to the test site immediately. lf <br />a driver is performing a safety-sensitive function at the time of his/her <br />notification of a random test requirement, he/she will be required to cease <br />performing the safety-sensitive function and proceed to the testing site as <br />soon as possible. However, a driver will only be required to submit to a <br />random alcohol test if the driver is performing a safety-sensitive function, is <br />about to perform a safety-sensitive function, or has just ceased performing a <br />safety-sensitive fu nction. <br />Reasonable Suspicion <br />Whenever Visu-Sewer has reasonable suspicion to believe that a driver has <br />engaged in prohibited conduct, except for the prohibitions on possession of <br />alcohol (49 CFR ,382.204), it will require that driver to submit to an alcohol <br />and/or controlled substances test. However, any such suspicion must be <br />based upon specific, contemporaneous, articulable observations concerning <br />the appearance, behavior, speech or body odors of the driver, which may <br />include indications of the chronic and withdrawal effects of controlled <br />substances. These observations will only be made by a supervisor or <br />company official who has received appropriate training and will be <br />documented by that individual in a Report of Reasonable Cause/Suspicion <br />within twenty-four (2$ hours after his/her observations, or before any drug <br />test results are released (APPENDIX G - REPORT OF REASONABLE <br />CAUSE/SUSP/C/OM. Any person who makes a determination that <br />reasonable suspicion exists to require a driver to submit to an alcohol test will <br />not be permitted to conduct the alcohol test for that driver. <br />A reasonable suspicion alcohol test will only be required if the reasonable <br />suspicion observations are made during, just preceding or just after the <br />period of the work day that a driver is required to be in compliance with this <br />Policy. A driver will therefore be directed to undergo reasonable suspicion <br />alcohol test only while performing a safety-sensitive function, just before the <br />performance of a safety-sensitive function, or just after the performance of <br />ZO
