Sew_er will notify a driver that the test is being required pursuant to this Policy and <br />the Federal Motor carrier Safety Regulations. Visu-Sewer will not, however, <br />represent that any requested test is required by federal regulations if, in fact, the <br />individual to be tested is not subject to those regulations. Testing procedures for <br />alcohol and drug tests will be conducted under Part 382 will follow the procedures <br />listed in Part 40 (APPENDIX J - SPECIMEN COLLECTION PROCEDURE). <br />. Pre-Employment/Pre-Duty <br />Prior to the first time a driver performs a safety-sensitive function for Visu- <br />Sewer (including prospective employees and employees transferring into a <br />position requiring the operation of a commercial motor vehicle), he/she will be <br />required to undergo testing for alcohol and controlled substances and will not <br />be allowed to perform any such function unless a verified negative drug test <br />result is received from the medical review officer. <br />Post-Accident <br />Any driver involved in an accident will be required to submit to tests for <br />alcohol and controlled substances as soon as practicable following the <br />accident, if the driver: <br />a <br />. Was performing safety-sensitive functions with respect to the vehicle <br />and the accident involved the loss of human life; or <br />. Received a citation under State or local law for a moving traffic <br />violation arising from the accident. <br />For purposes of this Policy, an "accident" is defined as an occurrence <br />involving a commercial motor vehicle operating on a public road which results <br />tn: <br />. A fatality; <br />. Bodily injury to a person who, as a result of the injury, <br />immediately receives medical treatment away from the <br />scene of the accident; or <br />. One or more motor vehicles incurring disabling damage as a <br />result of the accident, requiring the vehicle to be transported <br />away from the scene by a tow truck or other vehicle. <br />Exception. This section does not apply to: occurrence involving only boarding <br />or alighting from a stationary motor vehicle; or an occurrence involving only <br />the loading or unloading of cargo; or an occurrence in the course of the <br />operation of a passenger car or a multipurpose not-for-hire passenger <br />vehicle. <br />Drivers are prohibited from using alcohol for 8 hours following any accident or <br />until the required post-accident alcohol test is administered, whichever occurs <br />first. Every effort will be made to conduct post-accident drug and alcohol <br />tests within 2 hours following an accident. Any driver involved in an accident <br />must therefore remain readily available for testing and will be considered to <br />24
