discuss the use of this medication with the medical review officer and may be <br />required to identify the physician prescribing the medication and authorize the MRO <br />to discuss the use of the medication with that physician, including its possible side <br />effects and its relationship to the driver's ability to safely operate a commercial <br />motor vehicle. <br />ln the event it is determined that a driver is taking or is under the influence of a <br />prescribed medication that will adversely affect his/her ability to safely operate a <br />commercial motor vehicle and/or pose a significant risk of substantial harm to the <br />driver or the general public, the driver will be removed from the performance of any <br />safety-sensitive functions and/or placed on a medical leave of absence until that <br />threat is acceptably reduced or eliminated. Visu-Sewer further reserves the right to <br />place any employee taking a prescribed medication on a temporary medical leave of <br />absence untilthe information described above is provided. <br />Drug And Alcohol Background Check <br />Any driver Visu-Sewer intends to hire or use to perform a safety-sensitive function <br />wilt be required to undergo a background check to determine his/her compliance <br />with the drug and alcohol prohibitions of the Federal Motor Carrier Safety <br />Regulations during the previous 2 years. All drivers will therefore be required to sign <br />an appropriate consent form authorizing their previous employers to release this <br />information to Visu-Sewer (APPENDIX C - SAFETY PERFORMANCE HISTORY <br />RECORD (DOT-REG U LATED EMPLOYEES). <br />Visu-Sewer will then obtain information on the driver's alcohol tests with a <br />concentration result of 0.04 or greater, positive drug test results and refusals to be <br />tested, within the preceding 2 years from all of the driver's previous employers <br />during that time period. This information may be provided through a personal <br />interview, telephone interview, letter or other confidential method and will be <br />maintained in a confidential reference file. <br />Visu-Sewer will make a good faith effort to obtain and review the above information <br />prior to allowing a driver to perform a safety-sensitive function. lf this is not feasible, <br />Visu-Sewer will attempt to obtain the required information within 14 days after the <br />first time the driver performs a safety-sensitive function, regardless of that <br />individual's subsequent performance of those duties. No driver will be allowed to <br />perform a safety-sensitive function if this information has not been obtained within <br />14 days, unless Visu-Sewer is unable to do so through no fault of its own. ln the <br />event of such a circumstance, Visu-Sewer will document its efforts to obtain the <br />requested information in the reference file. <br />No driver will be allowed to perform a safety-sensitive function if Visu-Sewer <br />discovers that he/she has had an alcohol test with a concentration of 0.04 or <br />greater, a verified positive drug test result or has refused to be tested, unless and <br />until Visu-Sewer confirms that the driver has undergone an assessment by a <br />substance abuse professional (SAP), has complied with any recommendations the <br />SAP may have made with respect to rehabilitation, and has passed return-to-duty <br />drug and/or alcohol tests. <br />Notice Of Testing Gircumstances <br />Before performing any alcohol or controlled substances test under this Policy, Visu- <br />23
