Employees Subject To Testing <br />The Part 382 regulations do not end Visu-Sewer's authority to include requirements <br />not listed in Part 382. ( ' 382.171) Visu-Sewer's Policy meets and often exceeds the <br />requirements required by the Federal Motor Carrier Regulations. <br />The drug and alcohol testing required under this Policy will apply to any individual <br />who operates a commercial motor vehicle in interstate or intrastate commerce and is <br />required to possess a commercial driver's license. The requirements of this Policy <br />will therefore specifically apply to employees who work in positions that require <br />operation of a commercial motor vehicle and possession of a commercial driver's <br />license. <br />For purposes of this Policy, a "commercial motor vehicle" is defined as a motor <br />vehicle or combination of motor vehicles used to transport passengers or property <br />which: <br />Has a gross combination weight rating of 26,001 or more pounds inclusive of <br />a towed unit with a gross motor vehicle weight rating of more than 10,000 <br />pounds; or <br />Has a gross vehicle rating of 26,001 or more pounds; or <br />ls designed to transport 16 or more passengers, including the driver; or <br />o <br />a <br />a <br />a ls of any size and is used in the transportation of hazardous materials required to be <br />placarded under the Hazardous Materials Transportation Act. <br />A driver subject to this Policy will include any person who operates a commercial <br />motor vehicle, including but not limited to the following: <br />. Fulltime, regularly employed drivers; <br />. Casual, intermittent or occasional drivers; and <br />Leased drivers and independent, owner-operator contractors who are either <br />directly employed by or under lease with Visu-Sewer or who operate a <br />commercial motor vehicle at the direction of or with the consent of Visu- <br />Sewer. <br />The rules in Part 383, Commercial Driver's License Standard; Requirements and <br />Penalties, are applicable to every person who operates a commercial motor vehicle <br />in interstate or intrastate commerce and to all employers of such persons. <br />Because this drug and alcohol testing program is required by the Federal Motor <br />Carrier Safety Regulations, its provisions will apply to any individual who operates a <br />motor vehicle on behalf of Visu-Sewer pursuant to any contract, lease or other <br />agreement with Visu-Sewer, even though such individual may not be an employee <br />of Visu-Sewer.
