Where the driver is charged with the compliance to a requirement, <br />Section 390.11 makes Visu-Sewer responsible for requiring driver compliance. <br />Visu-Sewer's Policy mirrors the Federal Highway Administration's policy in that <br />drivers on the highways of the Nation be free from the influence of drugs and <br />alcohol. The information presented in this Policy is current at the time of the Policy's <br />issuance. Any changes to the FMCSR will govern the Program as it pertains to <br />Visu-Sewer's Policy. <br />Controlled Substances/Alcohol Testing Program <br />ln order to achieve the goal of ensuring a drug and alcohol-free transportation <br />system, as well as to comply with requirements of the Omnibus Transportation <br />Employee Testing Act of 1991 and the Federal Motor Carrier Safety Regulations, <br />Visu-Sewer has developed and established a controlled substance/alcohol testing <br />program that complies with Part 382-Controlled Substances and Alcohol Use and <br />Testing, and Part 40 Procedures For Transportation Workplace Drug and Alcohol <br />Testing Programs published in the Federal Motor Carrier Safety Regulations. <br />The purpose of Part 382 is to establish programs designed to help prevent <br />accidents and injuries resulting from the misuse of alcohol or use of controlled <br />substances by drivers of commercial motor vehicles. Part 40 establishes <br />procedures for alcohol or controlled substances testing to be conducted under the <br />programs established by Part 382. <br />The Program is designed to help prevent accidents and injuries resulting from the <br />misuse of alcohol and controlled substances by drivers of commercial motor <br />vehicles. While it is difficult to estimate the precise cost to society from alcohol <br />misuse, there is no doubt that the cost is enormous. The potential effects of alcohol <br />misuse are substantial in terms of lives lost, personal injuries, property damage, <br />business losses (lost productivity, absenteeism, increased health care costs, etc.) <br />and environmental damage. lmplementation of this Program will also help <br />discourage substance abuse, reduce absenteeism, accidents, health care costs and <br />other drug-related problems, and operate as a deterrent to those individuals who <br />might be tempted to try drugs for the first time or who currently use drugs. Finally, <br />we believe that this program will enhance the safety and health of our employees <br />and the users of the highways by fostering the early identification and referral for <br />treatment of workers with drug or alcohol abuse problems. <br />Visu-Sewer's drug and alcohol testing program is designed to create a drug and <br />alcohol-free transportation system and to provide help to those employees who may <br />be suffering from problems with chemical dependency. The program has therefore <br />been developed in compliance with federal regulations in a manner which ensures <br />accurate and reliable test results, thereby eliminating the possibility of any "false <br />positives." lt also contains procedures designed to recognize and respect the <br />dignity and privacy of all of our employees. We have established an appropriate <br />referral, evaluation and treatment programs designed to help those individuals <br />desirous of treating problems with alcohol and drug abuse. <br />I1
