a An employee may receive a verbal and/or written warning for any action that <br />management may deem necessary to comply with this Policy when related to job <br />performance, attendance, job responsibilities or safety. <br />LAWS RELATING TO DRUG TESTING POLICIES <br />Visu-Sewer is required to conform and comply with Federal and State laws and <br />regulations. The responsibility to comply with those laws and regulations is also placed <br />upon Visu-Sewer's employees. <br />U nemployment lnsurance <br />Benefits for unemployed workers in Wisconsin are provided by The Wisconsin Department <br />of Workforce Development Unemployment lnsurance Program (Wisconsin Unemployment <br />lnsurance Law, Chapter 108, Wisconsin Statutes)and in Minnesota are provided by the <br />Federal Unemployment Tax Act, and the Minnesota jobs and training law (Minnesota <br />Reemployment lnsurance). Under those laws, a claimant may be disqualified from <br />receiving benefits if the employee has been terminated from employment and is guilty of <br />misconduct. Misconduct may include failure to obey any reasonable rule adopted and <br />reasonably enforced by the employer for the safety of the employee. Employee <br />misconduct is additionally considered for failure to obey any reasonable rules of <br />employment when the employee is employed. <br />Workers Compensation <br />Workers compensation insurance programs provide an injured employee with the means to <br />obtain medical attention and reasonable compensation for the damage he or she suffered <br />while on the job. lf an injury is caused by the failure of an employee to obey any <br />reasonable rule adopted and reasonably enforced by the employer for the safety of the <br />employee and of which the employee has notice; or if the injury results from intoxication of <br />the employee, an employee's compensation and benefits may be reduced by up lo 15o/o, <br />not to exceed $15,000. <br />Drug Free Workplace Act <br />The Drug Free Workplace Act of 1988 requires that all federal government contractors and <br />organizations with federal grants maintain a drug-free workplace. The primary purpose of <br />the Act is to prohibit the unlawful manufacture, distribution, possession or use of a <br />acontrolled substanceG by an employee in any workplace involved in the performance of a <br />government contract or work involving a government grant. <br />The law applies to all employers/government contractors on contracts for property or <br />services of a value of $25,000 or more and to all recipients of federal government grants in <br />any amount. Under provisions of the Act, employers/contractors receiving grants who do <br />not comply with the Act are subject to the following penalties: risk loss of the grant or <br />federal contract; lose the right to future grants or government contracts, or if a decision is <br />made to debar, Visu-Sewer may not receive a grant or take part in a contract for a period <br />of up to five years. <br />I4
