a <br />Visu-Sewer reserves the right to perform tests for other illegal substances as well <br />Results of the tests will be the property of Visu-Sewer and held in the strictest of <br />confidence. <br />No specimen will be considered epositiveG (positive is defined as the presence of <br />one or more controlled substances at or above levels determined by the DHHS) until <br />it has been confirmed at the cut-off levels established by DHHS. ln the event that <br />no such levels have been established for that drug, Visu-Sewer will rely on the <br />laboratory and its consultants to establish a eforensically accepted level.G <br />Alcohol <br />Alcohol testing will be conducted by a breath alcohol technician (BAT) trained to <br />proficiency in the operation of the evidential breath testing device (EBT) he or she is <br />using and in the alcohol testing procedures required for the alcohol testing. For <br />evidential testing of breath, The EBT must be approved by the National Highway <br />Traffic Safety Administration (NHTSA) for the evidential testing of breath and placed <br />on NHTSA's Aconforming Products List of Evidential Breath Measurement DevicesG <br />(CPL), and identified on the CPL as conforming with the model specifications <br />available from the National Highway Traffic Safety Administration, Office of Alcohol <br />and State Programs. A test result for alcoholwhich reveals a blood/alcohol content <br />of .04 or greater is a positive test result under this Policy. All breath alcohol test <br />results will be confirmed by the Breath Alcohol Technician (BAT). <br />Reporting Results <br />All positive drug test results will be first reported by the Medical Review Officer (MRO). lf <br />the specimen is positive, the MRO will attempt to contact the employee at the daytime <br />number provided at the time of urine specimen submission for the purpose of discussing <br />the test results. Should the MRO fail to make contact on that attempt, he/she may contact <br />Visu-Sewer to ask for assistance in reaching the employee. lf the MRO does not make <br />contact within an additional maximum of five days or if the result appears to create <br />immediate safety concerns, the MRO may disclose the results to Visu-Sewer prior to <br />speaking with that employee. Visu-Sewer reserves the right to immediately remove the <br />employee from active duty until such time as the MRO is able to make contact and provide <br />a final result. lf, when the MRO reaches the employee, the employee is able to provide <br />substantiation of legitimate use, the positive result will be reported to Visu-Sewer as <br />enegativeG (negative is defined as the absence of a controlled substance at or above the <br />levels of detection determined by DHHS). lf no legitimate reason for the positive result is <br />found, that positive result will be provided to Visu-Sewer. <br />Positive Test Results <br />A positive test result does not automatically identify an employee or prospective employee <br />as a drug or alcohol user. A medical review officer (MRO) will evaluate positive results with <br />the employee or prospective employee to determine whether or not there are any reasons <br />or interpretations of the test that may have resulted in a false positive test. Employees or <br />prospective employees should report any overthe-counter or prescription medication that <br />10
