Cash Discount <br />50% Down payment due prior to start of the job <br />BALANCE DUE UPON COMPLETION OF WORK <br />If customer fails to make payment, Asscher Roofing LLC may terminate this contract and recover payment for the work <br />performed, all other costs, damages, and expenses, including reasonable attorneys' fees and other costs and expenses of <br />collection. <br />An additional charge of 3.5% will be applied to the total cost of completed job for credit card payments . A charge of 2% <br />per month (24% per annum) will be made on past due balance —with a $5 minimum service charge. Payment is made as <br />follows: 50% payment due before start of job with balance due day of job completion. <br />Concealed Conditions --If concealed, unanticipated, or unforeseen conditions are encountered, Asscher Roofing LLC shall <br />notify the customer and the contract price shall be adjusted by Asscher Roofing on the basis of the actual cost of additional time <br />and materials, unless a mutually agreed change order is signed. <br />Insurance —Customer may have insurance that provides coverage for the work. Asscher Roofing LLC can't guarantee that <br />customer's insurer will provide coverage or pay the contract price in whole. Customer understands and acknowledges that its <br />insurer isn't a party to this contract and that customer is responsible for paying for the work regardless of whether its insurer <br />provides coverage. If the customer's claim will be partially or wholly covered by insurance, the subject real property will be <br />repaired or restored to the same condition in which the real property existed before the damage, loss, or expense occurred, or <br />to a comparable condition. Asscher Roofing LLC shall not assert any insurance claim on the customer's behalf. Asscher <br />Roofing LLC carries workers' compensation insurance and liability insurance, as well as any insurance required by law. <br />Disputes-- Asscher Roofing LLC and customer agree that they will try to resolve all disputes or claims that may arise under this <br />contract amicably between themselves. The parties consent and agree that exclusive venue, personal jurisdiction, and subject <br />matter jurisdiction for any litigation involving all such disputes or claims shall be in St. Joseph County, Indiana. Asscher Roofing LLC shall perform the work in accordance with <br />the contract documents, manufacturer's specifications, and applicable law. Asscher Roofing LLC shall have sole <br />control over means, methods, techniques, sequences and procedures to complete the work. Asscher Roofing LLC <br />shall provide and pay for all labor, materials, supplies, tools, equipment, and machinery reasonably necessary to <br />complete the work. Some variation may occur in color, texture, and plans of materials. Asscher Roofing LLC may <br />utilize subcontractors, vendors, suppliers or others who aren't a party to this contract to provide labor, services, <br />material, equipment or machinery in connection with the work. Contract Documents: The contract documents <br />include: (a) the proposal and any drawings, plans and specifications for the work set forth in the proposal; (b) this <br />roofing contract; and (c) any change orders. The contract documents for the entire and integrated contract between <br />customer and Asscher Roofing LLC and supersede all prior written or oral negotiations, representations, or <br />agreements. Cancellation: You may cancel this contract at any time before midnight on the third business day after <br />the later of the following: (a) The date this contract is signed by you and Asscher Roofing LLC. (b) If applicable, the <br />date you receive written notification from your insurance company of a final determination as to whether all or any <br />part of your claim or this contract is a covered loss under your insurance policy.
