REGULAR MEETING AUGUST 28, 2000 <br />BILL NO. 47-00 A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br />BEND, INDIANA, ANNEXING TO AND BRINGING WITHIN <br />THE CITY LIMITS OF SOUTH BEND, INDIANA, CERTAIN <br />LAND IN CENTRE TOWNSHIP CONTIGUOUS THEREWITH; <br />SYLVIA R. HOUSER REVOCABLE TRUST <br />Councilmember Coleman made a motion to continue this bill until the October 9, 2000 meeting of <br />- the Council at the request of the Petitioner. Councilmember Varner seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br />BILL NO. 64 -00 A BILL TO VACATE THE FOLLOWING DESCRIBED <br />PROPERTY: THE FIRST NORTH /SOUTH ALLEY EAST OF <br />MICHIGAN STREET FROM THE NORTH RIGHT -OF -WAY <br />LINE OF BROADWAY STREET TO THE SOUTH RIGHT -OF- <br />WAY LINE OF THE FIRST EAST /WEST ALLEY NORTH OF <br />BROADWAY STREET FOR A DISTANCE OF 156 FEET AND A <br />WIDTH OF 14 FEET, LOCATED IN HANEY'S ADDITION <br />RECORDED IN PLAT BOOK 6, PAGE 13 IN THE OFFICE OF <br />THE ST. JOSEPH COUNTY RECORDER, CITY OF SOUTH <br />BEND, ST. JOSEPH COUNTY, INDIANA <br />Councilmember Coleman made a motion to continue this bill until the September 25, 2000 meeting <br />of the Council at the request of the Petitioner. Councilmember Varner seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br />BILL NO. 70 -00 A BILL TO VACATE THE FOLLOWING DESCRIBED <br />PROPERTY: A STRIP OF GROUND COMMENCING ONE <br />HUNDRED FIFTY (150) FEET NORTH OF THE SOUTHWEST <br />CORNER OF LOT 165 AS SHOWN ON THE RECORDED PLAT <br />OF MYERS AND FUNK'S THIRD PLAT OF CHIPPEWA <br />HEIGHTS ADDITION TO THE CITY OF SOUTH BEND, <br />INDIANA, AS A POINT OF BEGINNING, THENCE NORTH <br />ALONG THE WEST LINE OF SAID LOT 165, A DISTANCE OF <br />TWENTY -FOUR (24) FEET, THENCE EAST PARALLEL TO <br />THE SOUTH BOUNDARY LINE OF SAID LOT 165 ONE <br />HUNDRED TWENTY -EIGHT AND ELEVEN ONE <br />HUNDREDTHS (128.11) FEET, THENCE SOUTH ALONG THE <br />EAST LINE OF LOT 165 TWENTY -FOUR FEET (24), THENCE <br />WEST PARALLEL TO THE SOUTH BOUNDARY LINE OF SAID <br />LOT 165 ONE HUNDRED TWENTY -EIGHT AND ELEVEN ONE <br />HUNDREDTHS (128.11) FEET TO THE PLACE OF BEGINNING <br />Councilmember Varner reported that the Public Works and Property Vacation Committee met on <br />this bill and sends it to the Council with a favorable recommendation. <br />Mr. Travis R. Saunier, GPD Associates, 520 South Main Street, Akron, Ohio, representing Tricon <br />Global Restaurants for the redevelopment of the Taco Bell Project, made the presentation for this <br />vacation. <br />Mr. Saunier stated that when they submitted a site plan to redevelop the Taco Bell at 231 East <br />Ireland Road the issue of this Easement was questioned by the City Engineer who recommended that <br />they petition to have that Easement vacated. This is an Access Easement that was put in place some <br />years ago and at this time Taco Bell has no use for the Easement. The vacation will not hinder the <br />development of the properties on either side and therefore, they would like to vacate the Easement. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br />
