DRUG & ALCOHOL POLICY <br />IMPAIRMENT-FREE WORKPLACE <br />Updated September 1, 2023 <br /> <br /> <br /> <br />No application of this policy will violate any applicable local, state, or federal law. Equal Opportunity Employer <br />Employee Policies are subject to change at any time without notice to employees. <br />Overview <br />In compliance with the Drug-Free Workplace Act of 1988, L-D has a longstanding commitment <br />to provide a safe, quality-oriented, and productive work environment. The use, possession, <br />transportation, solicitation or sale of alcohol or drugs (unprescribed drugs or any illegal drugs) <br />by anyone while on Company business or Company premises is absolutely prohibited. In <br />addition, the Company prohibits any employee being at work or working under the influence of <br />alcohol or drugs, irrespective of the degree of physical or mental impairment the employee may <br />be experiencing. This policy includes the intentional misuse of prescribed drugs as well as the <br />illegal use of unprescribed drugs. Any violation of these rules by any employee while on <br />company business or Company premises will be cause for disciplinary action, ranging from <br />verbal or written reprimand to immediate discharge and referral to law enforcement agencies. <br /> <br />Expectations <br /> <br />The presence of any detectable amount of any illegal drug, illegal controlled substance, or <br />alcohol in an employee’s body system, while performing company business or while in a <br />company facility, is prohibited. <br />L-D will also not allow employees to perform their duties while taking prescribed drugs that are <br />adversely affecting their ability to perform their job duties safely and effectively. Employees <br />taking a prescribed medication must carry it in a container labeled by a licensed pharmacist or <br />be prepared to produce the container if asked. <br />Employees should report to work fit for duty and free of any adverse effects of illegal drugs or <br />alcohol; impairment-free. This policy does not prohibit employees from the lawful use and <br />possession of prescribed medications. Employees must, however, consult with their doctors <br />about the medications’ effect on their fitness for duty and ability to work safely, and they must <br />promptly disclose any work restrictions to their supervisor. <br />Any illegal drugs or drug paraphernalia will be turned over to an appropriate law enforcement <br />agency and may result in criminal prosecution. <br />The term “company premises” includes all property, buildings, structures, jobsites, parking lots <br />and means of transportation owned by or leased to the company or that which is under the <br />control of the company, the responsibility of the company or otherwise being utilized for <br />company business. <br /> <br />
