REGULAR MEETING SEPTEMBER 22, 2003 <br />Coleman seconded the motion which carried by a voice vote of eight (8) ayes. <br />Councilmember Aranowski made a motion to send Bill No. 65 -03 to the full Council with a <br />favorable recommendation. Councilmember Pfeifer seconded the motion which carried by a voice <br />vote of eight (8) ayes. <br />Councilmember Aranowski made a motion to send Bill No. 66 -03 to the full Council with a <br />favorable recommendation. Councilmember Coleman seconded the motion. <br />Councilmember Varner advised that Bill No. 66 -03 contains and continues to contain the request <br />for funding without adequate accountability on the part of this Council and ends up being just a <br />transfer. He stated that he does not question that there has been a contractual arrangement but <br />questions whether the Council is fulfilling its obligation to actually meet the accountability standards <br />that are established for so many other disbursals and funds and for that reason he will not support <br />the passage of this bill. <br />The motion carried by a voice vote of seven (7) ayes and one (1) nay vote by Councilmember <br />Varner. <br />PUBLIC HEARINGS <br />BILL NO. 70 -03 PUBLIC HEARING ON A BILL TO VACATE THE <br />FOLLOWING DESCRIBED PROPERTY: THE ALLEY TO <br />BE VACATED IS THE FIRST NORTH/SOUTH ALLEY <br />EAST OF CATALPA AVENUE FROM INDIANA <br />AVENUE NORTH TO THE FIRST EAST/WEST ALLEY. <br />A DISTANCE OF 120 FEET, AND A WIDTH OF 14 FEET, <br />BEING A PART OF RAFF'S 3RD ADDITION TO THE <br />CITY OF SOUTH BEND, ST. JOSEPH COUNTY, <br />INDIANA <br />Councilmember Varner, Chairperson, Public Works and Property Vacation Committee, reported <br />that this committee held a Public Hearing on this bill this afternoon and sends it to the Council with <br />a favorable recommendation as amended. <br />Council Attorney Kathleen Cekanski- Farrand read into the record the following amendment: <br />New Section V: This vacation shall be subj ect to the Petitioner providing an Easement <br />Agreement acceptable to the City's Department of Public Works <br />which provides for a minimum ten foot (10') setback available for <br />utility vehicle turning. <br />Attorney Cekanski- Farrand noted that she has spoken to the Petitioner and he is agreeable to this <br />amendment. <br />Councilmember Coleman made a motion to accept this amendment as read.
