refuses to fill out and sign the written consent form agreeing to <br />submit to the medical examination and/or testing and permitting <br />Ritschard to be apprised of the testing results or fitness -for -duty <br />evaluation (Consent Form 2), will be subject to immediate discharge. <br />(c) An employee who switches or adulterates any sample submitted for <br />testing will be subject to immediate discharge. <br />F. EMPLOYEE ASSISTANCE PROGRAM <br />1. Employees who are determined, as a result of the fitness -for -duty <br />evaluation, to have used chemical substances in excess of the limits set forth <br />in Exhibit A, shall be required to attend and pay for at their own expense <br />a treatment program offered by an outside provider. The cost of the <br />program will be fully explained to each employee. Refusal to participate <br />in or complete the program or the after -care program will result in the <br />employee's termination. <br />2. Employees who believe that they have a chemical substance problem should <br />promptly contact the President of the Company. The employee will be <br />given the opportunity to enroll in a voluntary program operated by <br />professional counselors. The cost of the program will be fully explained to <br />each employee. <br />3. Employees who participate in the program will be tested for chemical <br />substances in accordance with the provisions of the program until the <br />program ends. A positive test result following the commencement of the <br />program will subject the employee to immediate discharge. <br />4. Employees who complete the program will be tested for chemical <br />substances in accordance with the recommendations of the Medical Review <br />Officer. The days on which the testing will occur will be unannounced. <br />If an employee tests positive for chemical substances after the completion <br />of the program, the employee will be subject to immediate discharge. If <br />eighteen (18) months pass without a positive test for chemical substances, <br />there will be no presumption in the future that the employee is using a <br />chemical substance or is under the influence. If, in the future, the <br />employee is subject to action under this policy, the employee shall be <br />treated as if he or she never underwent a fitness -for -duty evaluation. <br />IRE <br />
