(iii) The test is conducted as part of an employee assistance <br />program sponsored or authorized by the employer in which <br />the employee voluntarily participates. <br />(iv) The employee's occupation separates the employee from a <br />supervisor's ability to ascertain whether the employee is in an <br />unfit condition. <br />(b) The employee selected for random testing and the employee's direct <br />supervisor will be notified within two (2) hours of the scheduled <br />testing. <br />(c) If the employee was randomly selected, the Company shall explain <br />to the employee that the employee is under no suspicion and that the <br />employee's name was selected randomly. <br />(d) An employee selected for random testing may obtain a deferral of <br />testing if the employee's supervisor and another management person <br />concur that there is a compelling need to defer the testing. An <br />employee whose random test is deferred will be subject to an <br />unannounced test within the following sixty (60) days. <br />5. Evaluation Procedure. <br />(a) An employee may be requested to undergo a fitness -for -duty <br />evaluation if- <br />(i) The employee appears to be in an unfit condition at work; <br />(ii) The employee demonstrates unsatisfactory job performance; <br />(iii) The employee demonstrates a history of unsatisfactory job <br />performance; <br />(iv) The employee is involved in off -duty misconduct; or <br />(v) The employee is involved in a reportable accident while on <br />the job. <br />(b) An employee who (1) refuses to submit to a fitness -for -duty <br />evaluation in accordance with the provisions of this policy, or (2) <br />-5- <br />
