3. Unsatisfactory Job Performance: Incidents which indicate job performance <br />problems, including, but not limited to, the following: (a) unexplained <br />work errors; (b) unusual difficulty in performing normal or routine duties; <br />(c) unexplained on-the-job accident; (d) unexplained on-the-job injury. <br />4. History of Unsatisfactory Job Performance: A pattern of recurring job <br />performance problems such as poor work performance, absenteeism, <br />tardiness, minor injuries/accidents or other job difficulties. <br />5. Reportable Accident: Any accident on the job which results in death or <br />bodily injury to one or more individuals requiring medical treatment away <br />from the accident scene, or damages to property totalling $500.00. <br />6. Off -Duty Misconduct: Any arrest by a law enforcement agency for off -duty <br />use, sale or possession of chemical substances or for other off -duty drug <br />activity. <br />7. Fitness -for -Duty Evaluation: A medical examination which may include <br />testing for chemical substances. <br />8. Positive Test. A positive test is one which indicates the presence of any <br />drug listed in Exhibit A. <br />9. Negative Test. A negative test is one which does not indicate the presence <br />of any drug listed in Exhibit A. <br />D. PRE -EMPLOYMENT DRUG SCREENING POLICY <br />1. All individuals submitting applications for employment to Ritschard will be <br />provided with a copy of the written Notice to All Applicants and will be <br />orally informed, at the time of making application, about the requirement <br />of a urine drug screen. All applicants must sign a copy of the notice <br />acknowledging that the applicant has received a copy of the Notice. <br />2. All applicants who meet the criteria for employment will be screened for <br />drugs prior to being made an offer of employment. In the unlikely event <br />that it is necessary to make an offer of employment prior to the applicant <br />undergoing drug screening, the offer shall be made contingent upon the <br />applicant's compliance with the drug screening program. The applicant will <br />be specifically informed that if the applicant refuses to fully cooperate with <br />-2- <br />
