• <br /> ORDINANCE NO.7 5'- g'5 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND, INDIANA, AMENDING ARTICLE 9 OF <br /> CHAPTER 20 OF THE MUNICIPAL CODE OF THE CITY OF <br /> SOUTH BEND, INDIANA, COMMONLY KNOWN AS <br /> "MOBILITY HANDICAPPED PARKING" <br /> In 1978, the Common Council passed legislation which has assisted <br /> mobility handicapped persons in their access to parking. <br /> Presently the local ordinance permits persons with "Disabled Veteran <br /> Registration Plates", "Special Registration Plates", or "South Bend <br /> Handicapped Parking Permits" to legally park in locations designated for the <br /> exclusive use of mobility handicapped persons. <br /> The Council recognized that there are several commercial operations who <br /> transport handicapped individuals for a fee, who are prohibited from using <br /> such handicapped parking spaces because they do not meet one (1) of the <br /> three (3) classes of "Qualified Persons". <br /> The Council believes that these handicapped individuals who are <br /> transported by commercial vehicles designed for the handicapped, should also <br /> have the right to utilize designated handicapped parking spaces. This bill <br /> incorporates the appropriate amendments which are believed to be in the best <br /> interest of the City. <br /> NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of <br /> South Bend, Indiana, as follows: <br /> SECTION I. Article 9 of Chapter 20 of the Municipal Code of the City <br /> of South Bend, Indiana, is amended in part as follows: <br /> Article 9. Mobility Handicapped Parking. <br /> Section 20-110 Qualified Persons. <br /> (c) South Bend Handicapped Parking Permit. <br /> ..A..person-or `authorized 'commerical.vehicle -specifically designed to <br /> transport mobility- handicapped persons -for- a fee, who have been—issued a <br /> handicapped parking permit by the City bearing the permit number, permit <br /> holder's name, signature of the authorizing City official(s) , and the <br /> official international wheelchair symbol or a reasonable facsimile thereof <br /> shall be entitled to all of the parking privileges authorized by this <br /> Article. <br /> Section 20-111 Application and Permit Process. <br /> (c).
