ORDINANCE NO.74593-85 <br /> AN ORDINANCE AMENDING AND SUPPLEMENTING ARTICLE 8, <br /> SUBDIVISIONS, OF CHAPTER 21 , OF THE SOUTH BEND <br /> MUNICIPAL CODE, AS AMENDED, BY MODIFYING PROVISIONS <br /> RELATIVE TO FLOODPLAIN REGULATIONS AS PRESCRIBED <br /> BY THE FEDERAL EMERGENCY MANAGEMENT AGENCY <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City of South Bend has adopted provisions relative to flood plain <br /> regulations, so as to minimize or eliminate existing or potential flood hazards <br /> within such areas; and <br /> It is in the public interest for the City of South Bend to continue <br /> participation in the National Flood Insurance Program; and <br /> Certain provisions of the City of South Bend Municipal Code must be <br /> modified to establish compliance with the regulatory requirements of the <br /> National Flood Insurance Program. <br /> NOW, THEREFORE, be it ordained by the Common Council of the City of <br /> South Bend, Indiana, as follows: <br /> Section I <br /> That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South <br /> Bend Municipal Code, be amended by adding the following Section: <br /> Sec. 21-142. Subdivisions in flood hazard areas. <br /> (a) Proposed subdivisions shall be reviewed to determine <br /> whether the subdivision lies in a flood hazard area. If <br /> the subdivision is to be located in a flood hazard area, <br /> the Subdivider's Registered Land Surveyor shall forward <br /> pertinent plans and materials to the Department of <br /> Natural Resources for review and comment. Appropriate <br /> changes and modifications may be required in order to <br /> assure that the development of the subdivision is <br /> consistent with the need to minimize flood damages; all <br /> public utilities and facilities, such as sewer, gas, <br /> electrical , and water systems are located and constructed <br /> to minimize or eliminate flood damage; adequate drainage <br /> is provided so as to reduce exposure to flood hazards; <br /> and that on-site waste disposal systems, if provided, <br /> will be so located as to avoid impairment of them or <br /> contamination from them during the occurrence of the <br /> regulatory flood. <br /> (b) All subdivisions to be located in a flood hazard area <br /> shall have the elevation of the 100-year flood stated and <br /> the area delineated thereon. <br /> SECTION II <br /> That Article 8, Subdivisions, of Chapter 21 , Zoning, of the City of South <br />
