<br /> <br />S <br />RESOLUTION N0. 74 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT <br />AUTHORITY .APPROVING AND ACCEPTING TRANSFER OF REAL <br />PROPERTY FROM THE ST. JOSEPH COUNTY AIRPORT AUTHORITY <br />follows: <br />WHEREAS, the St. Joseph County Airport Authority <br />(hereinafter the "Airport Authority"), a governmental entity, is <br />the owner of a parcel of real property, situated in St. Joseph <br />County, Indiana, and being more particularly described as <br />A parcel of land 80 feet in width, located in <br />the Southeast Quarter (SE 1/4) of Section 20, <br />the South Half (S 1/2) of Section 21, and the <br />North Half (N 1/2) of Section 28, Township 38 <br />North, Range 2 East, German Township, St. <br />Joseph County, Indiana, the boundaries of <br />which lie 40 feet on each side of a <br />centerline and centerline extended, said <br />centerline described as follows: <br />• <br />Commencing at the Southwest corner of the <br />Southeast Quarter (SE 1/4) of Section 20; <br />thence North 00°19'53" West, along the West <br />line of said Quarter Section, 2135.00 feet; <br />thence. North 89040'07" East 78.50 feet to the <br />True Point of Beginning of this description; <br />thence North 89°40'07" East 1185.91 feet to a <br />point of curvature of a tangent curve to the <br />Right having a radius of 1600.00 feet and a <br />central angle of 28000'06"; thence southerly <br />and easterly along said curve 781.96 feet to <br />the West line of the property described in <br />Deed Record 7818352, Recorded the 25th day of <br />August, 1978,- of the Records of St. Joseph <br />County, Indiana. Containing 3.85 acres, more <br />or less, <br />(hereinafter referred to as the "Real Property"); and <br /> <br />WHEREAS, I.C. 36-1-11-8 provides for the transfer of real property <br />between governmental entities by adoption of substantially identical <br />resolutions; and <br />WHEREAS, pursuant to I.C. 36-7-14.5-12(°)(5) and (4), the <br />Redevelopment Authority may acquire and hold real property needed or <br />considered useful in connection with local public improvements; and <br />WHEREAS, pursuant to I.C. 8-22-3-10, the Airport Authority is <br />authorized to acquire and dispose of real property for use. or in <br />connection with or for administrative purposes of the airport; and <br />WHEREAS, the Airport Authority is desirous of transferring title <br />to the Real Property to the South Bend Redevelopment Authority <br />(hereinafter, the "Redevelopment Authority") so that the same may be <br />utilized for the construction of F. J. Nimtz Parkway, east of <br />Mayflower. Road; and <br />WHEREAS, .the Redevelopment Authority is desirous of acquiring the <br />Real Property from the Airport Authority in order to allow for the <br />construction of this portion of F. J. Nimtz Parkway; and <br />.WHEREAS, by Resolution No. 33, adopted March 8, 1991,. the <br />• Redevelopment Authority has elected to abide by the provisions of I.C. <br />36-1-11-8 with regard to the transfer by or to it of real property to <br />or from another governmental entity; and. <br />WHEREAS, the Airport Authority has or will adopt a resolution <br />
