7.3.3 All the provisions of these easement reservations, including the benefits and <br />• burdens, run with the land and are binding upon and shall inure to the benefit of <br />the successors, successors in interest, assigns, heirs, tenants, and personal <br />representatives of the Owners and Occupants from time to time of Blackthorn. <br />7.3.4 The rule of strict construction does not apply to the easement reservations herein <br />above set forth.- Such reservations shall be gnren a reasonable construction so <br />that the intention of the Declarant as set forth in Article II of the Declaration is <br />carried out. <br />7.4 Installation and Maintenance Responsibilities ofLandscape Areas. In furtherance of the <br />purpose of these Declarations as stated in Article II herein. The folbwing establishes <br />installation and maintenance responsibilities ofthe Common Areas, the Landscape <br />Easement Areas, Open Space and Parking Landscape Areas, and Conservation <br />Easement Areas. <br />7.4. i Common Areas. All those areas shown as "Common Areas" on Exhibit "D" <br />initially will be landscaped and certain decorative Improvements constructed <br />thereon by the Declarant at such time the Declarant sees fit. However, the <br />Declarant wdl install landscaping elements within sections of the Common Area <br />which are adjacent to Blackthorn Sites currently under construction. After initial <br />installation, the landscaping shall be maintained by the Association in accordance <br />with the provisions of this Declaration and the Guidelines. It is the intent of <br />Declarant to dedicate the Common Areas tothe use of and by the Association. <br />7.4.2 Landscape Easement Areas. All those areas shown as "Landscape Easement <br />Areas" on Exhibit "E" initially will be landscaped and certain decorative <br />Improvements constructed thereon by Owner in accordance with the plans and <br />specrfications submitted to and approved by the Committee. After initial <br />installation the landscaping in such areas shall be maintained by the Owner until <br />such landscaping has remained healthy for a minimum of twelve (12) consecutive <br />calendar months. Thereafter, the Assoaation shall maintain landscaping in <br />accordance with the provisions of this Declaration and the Guidelines. <br />7.4.3 Open Space and Parking Landscape Areas. All those areas described as Open <br />Space and Parking Landscape Areas in the Guidelines shall be landscaped by <br />the Owner in accordance with the plans approved by the Committee. After <br />installation, the landscaping in such areas shall be maintained by the Owner in <br />accordance with the requirements of the Guidelines. <br />7.4.4 Conservation Easement Areas. Conservation Easements are established in this <br />Declaration to preserve and protect the natural systems found in Blackthorn. No <br />Improvements or alterations of any type are to be made to the Conservation <br />Easement Areas. The Owner must protect the natural systems found in the <br />Conservation Easement from any external, man-made interference; including <br />without limitation; construction processes, srte and parking lot drainage, lawn <br />Chem"icals and snow storage. Artificial maintenance of the vegetatan in said <br />Conservaton Easement Areas is prohibited without prior written approval ofthe <br />Committee. <br />t 5 Blackthorn Corporate Center -Covenants & Restrictions 4/199 <br />
