Disclosure of Alcohol Information/Records <br />General <br />1. Trisco Systems, Inc. shall maintain all alcohol related testing information <br />including all test results and other appropriate records in a secure manner to <br />prevent the disclosure of such information to unauthorized personnel. <br />2. The APM or designee shall maintain a locked file system which will contain the <br />alcohol testing information and records. This file shall be maintained as <br />confidential. Employee files shall be handled on a strict "need to know" basis. <br />3. Alcohol test results shall not be included in personnel files. <br />Disclosure Provisions <br />1. Trisco Systems, Inc. shall not release covered employee information that is <br />contained in records as required to be maintained by the provisions of the AMPP <br />and in accordance with federal requirements except as required by law or when <br />expressly authorized or required by 49 CFR Parts 382 and 40. Alcohol testing <br />data shall be maintained and reported to the DOT annually. <br />2. A covered employee is entitled, upon written request, to obtain copies of any <br />records pertaining to the employee's use of alcohol, including any records <br />pertaining to their alcohol tests. Trisco Systems, Inc. shall promptly provide the <br />requested records. Access to an employee's records shall not be contingent upon <br />payment for records other than those specifically requested. <br />3. Trisco Systems, Inc. shall permit access to all facilities utilized in complying with <br />the requirements of 49 CFR Parts 382 and 40 to the Secretary of Transportation, <br />and any DOT or state agency with regulatory authority over Trisco Systems, Inc. <br />4. Trisco Systems, Inc. shall make available copies of all results for alcohol testing <br />and any other information pertaining to the administrative process of the Trisco <br />Systems, Inc.'s AMPP as required by 49 CFR Parts 382 and 40 when requested <br />by the Secretary of Transportation, any DOT or state agency with regulatory <br />authority over Trisco Systems, Inc.. When specified by the agency the <br />information shall include name specific alcohol test results, records, and reports <br />5. When requested by the National Transportation Safety Board as part of an <br />accident investigation, Trisco Systems, Inc. shall disclose information related to <br />Trisco Systems, Inc. s administration of any post accident alcohol tests <br />administered following the accident under investigation. <br />6. Trisco Systems, Inc. shall make records available to a subsequent employer upon <br />receipt of a written request from a covered employee. Disclosure to the <br />subsequent employer is permitted only as expressly authorized by the terms of the <br />employee's written request. <br />7. Trisco Systems, Inc. may disclose required information pertaining to a covered <br />employee to that employee or to the decision maker in a lawsuit, grievance, or <br />other proceeding initiated by or on behalf of the individual, and arising from the <br />results of an alcohol test administered as required by the AMPP and the <br />regulations set forth in 49 CFR Parts 382 and 40 or from Trisco Systems, Inc.'s <br />49 <br />
