26 <br />personal leave and/or vacation time to cover any absence. An employee may be granted leave <br />for a maximum of 30 days for treatment, and may be extended up to an additional 30 days with <br />evidence of continuing treatment. An employee can then return to work when they have <br />complied with the Return to Duty Testing Requirements. <br /> <br />The SAP is not designed to provide treatment, but rather to provide assessment and referrals to <br />drug counseling and rehabilitation, education to the employees in the form of a Drug Free <br />Awareness Program, and training of supervisory personnel in spotting and dealing with drug and <br />substance abuse problems. <br /> <br />Rehabilitation <br /> <br />There are two general types of rehabilitation: <br /> <br />a) Out-patient visitation and/or counseling <br />b) Institutional rehabilitation followed by outpatient counseling. <br /> <br />For the purpose of this section, “Counseling and Out-Patient Counseling” shall be limited as <br />follows: <br />Employee will choose any approved counseling program recommended by the Substance <br />Abuse Professional. If the employee elects to use a counseling service, the employee <br />shall be responsible for all expenses in excess of his insurance paid. In addition, a <br />weekly progress report from the counseling service will be submitted to Trisco Systems, <br />Inc. The employee shall cooperate in executing a medical release providing Trisco <br />Systems, Inc., with releasing information related solely to the drug addiction problem <br />and counseling thereof. Three unexcused absences from either of the above referenced <br />counseling programs shall subject the employee to immediate termination. <br /> <br /> <br />Condition for Return to Work (after rehabilitation) <br /> <br />1) Employee will be tested at his expense two times during the first two months after <br />returning to work. If the employee successfully completes this rehabilitation, he will be <br />reimbursed one half of his drug test fees and expenses. Any additional testing will be at <br />Trisco Systems, Inc., expense. <br /> <br />2) After the first year, Trisco Systems, Inc. may continue periodic testing at Trisco Systems, <br />Inc., expense until the condition is considered fully cured. <br /> <br />3) Test results after returning to work: <br />a) Any positive test result for a person who has had a prior “positive” shall be <br />terminated immediately. <br />b) For the first positive test result for anyone who voluntarily sought help prior to <br />testing for rehabilitation, the employee shall be placed on an immediate leave of <br />absence and return to work only after a “negative” is obtained. Any second <br />positive test result shall be cause for immediate termination of employment.
