SUBSTITUTE <br /> BILL NO. 5-87 <br /> ORDINANCE NO. 72,4T-87 <br /> AN ORDINANCE AMENDING CHAPTER 17 <br /> OF THE SOUTH BEND MUNICIPAL CODE <br /> AND ESTABLISHING A SCHEDULE OF RATES , <br /> CHARGES AND SURCHARGES FOR SERVICES RENDERED <br /> BY THE SOUTH BEND WASTEWATER TREATMENT PLANT <br /> STATEMENT OF PURPOSE AND INTENT: <br /> The Common Council of the City of South Bend last established <br /> a schedule of rates and charges for services rendered by the Wastewater <br /> Treatment Plant of the City of South Bend and for the water service <br /> fund to repair water service line leaks , by Ordinance No . 7379-84 , <br /> which was adopted on August 27 , 1984 . Rates and charges were not <br /> increased at that time . <br /> Prior to August 27 , 1984 , the Common Council of the City of <br /> South Bend last established a schedule of rates and charges for <br /> services rendered by the Wastewater Treatment Plant of the City of <br /> South Bend by Ordinance No . 6828-80 , adopted on September 15 , 1980. <br /> The Council now finds that in order to meet the financial <br /> requirements of the Wastewater Treatment Plant , it is necessary that <br /> the rates and charges for the services be raised for the first time in <br /> six ( 6) years and be established as set forth below. <br /> The discharge of sewage containing high concentrations of <br /> phosphorus or in which the biochemical oxygen demand (BOD) or the <br /> suspended solids ( SS) are high , places an undue demand upon the <br /> facilities and personnel at the sewage treatment plant . The policy of <br /> the City of South Bend is that the cost of operating the sewage <br /> treatment plant should be borne in an equitable manner by the users of <br /> that plant , taking into account the amount and intensity of their <br /> demands upon the facilities and its personnel . <br /> The Council now finds that in order to meet the financial <br /> requirements of the sewage treatment plant , it is necessary that a <br /> heavy demand discharge rate be established as set forth below. <br /> NOW , THEREFORE , BE IT ORDAINED by the Common Council of the <br /> City of South Bend , Indiana , as follows : <br /> SECTION I . Chapter 17 , Article 2 , Section 17-5 of the <br /> Municipal Code of th'e City of South Bend , shall be amended by adding <br /> the following : <br /> ( 10. 1 ) Heavy Demand Substances are concentrations <br /> of phosphorus , suspended solids or biochemical <br /> oxygen demand in sewage which exceed the levels <br /> established in Section 17 -47.3(a ) of this chapter . <br /> SECTION II . Chapter 17 , Article 5 , Section 17-47. 1 of the <br /> Municipal Code of the City of South Bend , shall be amended in its <br /> entirety to read as follows : <br />
