SUBSTITUTE BILL NO. 5-87 ORDINANCE NO. 72,4T-87 AN ORDINANCE AMENDING CHAPTER 17 OF THE SOUTH BEND MUNICIPAL CODE AND ESTABLISHING A SCHEDULE OF RATES , CHARGES AND SURCHARGES FOR SERVICES RENDERED BY THE SOUTH BEND WASTEWATER TREATMENT PLANT STATEMENT OF PURPOSE AND INTENT: The Common Council of the City of South Bend last established a schedule of rates and charges for services rendered by the Wastewater Treatment Plant of the City of South Bend and for the water service fund to repair water service line leaks , by Ordinance No . 7379-84 , which was adopted on August 27 , 1984 . Rates and charges were not increased at that time . Prior to August 27 , 1984 , the Common Council of the City of South Bend last established a schedule of rates and charges for services rendered by the Wastewater Treatment Plant of the City of South Bend by Ordinance No . 6828-80 , adopted on September 15 , 1980. The Council now finds that in order to meet the financial requirements of the Wastewater Treatment Plant , it is necessary that the rates and charges for the services be raised for the first time in six ( 6) years and be established as set forth below. The discharge of sewage containing high concentrations of phosphorus or in which the biochemical oxygen demand (BOD) or the suspended solids ( SS) are high , places an undue demand upon the facilities and personnel at the sewage treatment plant . The policy of the City of South Bend is that the cost of operating the sewage treatment plant should be borne in an equitable manner by the users of that plant , taking into account the amount and intensity of their demands upon the facilities and its personnel . The Council now finds that in order to meet the financial requirements of the sewage treatment plant , it is necessary that a heavy demand discharge rate be established as set forth below. NOW , THEREFORE , BE IT ORDAINED by the Common Council of the City of South Bend , Indiana , as follows : SECTION I . Chapter 17 , Article 2 , Section 17-5 of the Municipal Code of th'e City of South Bend , shall be amended by adding the following : ( 10. 1 ) Heavy Demand Substances are concentrations of phosphorus , suspended solids or biochemical oxygen demand in sewage which exceed the levels established in Section 17 -47.3(a ) of this chapter . SECTION II . Chapter 17 , Article 5 , Section 17-47. 1 of the Municipal Code of the City of South Bend , shall be amended in its entirety to read as follows :
