All rights reserved. <br /> <br />This is EXHIBIT J, consisting of 1 page, referred to in and <br />part of the Agreement between Owner and Engineer for <br />Professional Services dated June 13, 2023. <br /> <br /> <br />Special Provisions <br /> <br />Paragraph(s) * of the Agreement is/are amended to include the following agreement(s) of the parties: <br /> <br />* Please note that any modifications to the original EJCDC document are identified by either a strike out <br />of a given word, sentence or paragraph or are underlined to reflect any insertions. <br /> <br />A. Exhibit A – Paragraph A.1.02.A.2. As a basis for this contract, it is assumed that the utilities will <br />provide the required project information and/or their as-builts at no charge to the Owner and/or Engineer <br />during the preliminary design phase. The Owner and/or Engineer, therefore, assume no liability in or <br />consequences of the provided locations of these utilities or the lack thereof. Also, it is assumed that if <br />conflicts with said utilities occur, no matter how minor, the costs to cure and conflict shall be borne by <br />the utility or paid for as a part of the project cost by the Owner and/or others. Any required engineering, <br />design and/or other services direct to or incidental thereof, to remedy said utility conflicts, necessary for <br />said relocation, shall be provided by others or as negotiated and upon mutual written agreement by the <br />Owner and Engineer for these services, and thereby shall be provided as an additional service within a <br />future contract amendment. <br /> <br />B. Paragraph A2.01 - Exhibit A – Additional Services <br /> <br />At the time of the execution of this Agreement, the only known additional services to be <br />performed by the Engineer are as follows: <br /> <br />1. Easement Assistance <br /> <br />Develop an easement description and exhibit for the new CSO 022 Structure and Throttle <br />Line Relocation. The Owner will lead the efforts for acquiring the easement. <br /> <br />The Engineer shall perform the above referenced services in accordance with Paragraph <br />C2.05 of Exhibit C, Compensation Packet AS-1, with an estimated fee of $5,000.00. <br /> <br />
